Though the matter is listed today for preliminary hearing, it is heard. 3. This petition is filed seeking following reliefs: a) Issue a Writ of Certiorari or any other Writ by way of quashing the Show Cause Notice bearing No.BG/BNG/RO/BLR(Central)/EXEMP/ 2025- 26/332/388 dated 13th April 2026 at ANNEXURE - A issued by the Respondent; b) Issue a Writ of Mandamus or any other Writ or a direction to the Respondent to consider the reply of the Petitioner dated 31st March 2026 at ANNEXURE - Y and conduct an enquiry in accordance with the law; - 3 - HC-KAR NC: 2026:KHC:31464 WP No. 15319 of 2026 c) Grant costs of the proceedings d) Pass such other order/s as this Hon'ble Court may deem fit to grant in the facts and circumstances of the case. 4. Counsel for the respective parties urged several contentions. Counsel for the petitioner, in advancing her arguments, vehemently contended that the show-cause notice was issued in such terms that it operated as a final order. It was urged that the petitioner was not allowed to put forth the contentions, and that the proceedings, therefore, stand vitiated as violative of the principles of natural justice. On this ground, counsel submitted that the impugned notice is liable to be quashed. Counsel for the respondent fairly submits that, though the impugned notice is styled as a show-cause notice, in substance it operates as a final order. It is therefore urged that an appropriate order be passed. 5. Perused the impugned notice with care. Though it is styled as a show-cause notice, in substance it operates as a - 4 - HC-KAR NC: 2026:KHC:31464 WP No. 15319 of 2026 final order. Consequently, the show-cause notice is liable to be quashed. Accordingly, Annexure-A stands quashed. A mandamus is issued directing the respondent to consider the reply submitted by the petitioner on 31.03.2026 in accordance with the law. Upon such consideration, an enquiry shall be conducted, and the matter shall be proceeded with in terms of the provisions of the Employees’ Provident Funds Act.
