Since common questions of fact and law arise for consideration in this batch of writ petitions, all the matters were clubbed together, heard analogously and are being decided by this common order. 26 2. The controversy involved in all these petitions broadly relates to the grievance of the petitioner societies against the action/inaction of the respondent authorities in the matter of lifting and transportation of procured paddy, the consequential shortage in weight on account of delay in lifting, and the coercive steps allegedly being adopted for recovery of the resultant loss from the petitioner societies and their functionaries. 3. For the sake of convenience, facts are being noticed from WPC No.3271 of 2026, which is treated as the lead case for disposal of the entire batch of petitions, as the issues involved in the remaining petitions are substantially similar. In the said lead petition, the petitioners have, inter alia, prayed for issuance of an appropriate writ restraining the respondents from effecting recovery of the alleged shortage/loss in paddy attributable to delay in lifting and consequential loss of moisture, for a direction to the respondents to consider the petitioners’ representations in accordance with the applicable procurement policy, to resolve the dispute strictly in terms of the policy governing procurement, lifting and transportation of paddy, and for grant of such other consequential reliefs as may be deemed just and proper in the facts and circumstances of the case. The petitioner in WPC No.3271 of 2026 has prayed for following relief(s) :- “10.1 A writ and/or an order in the nature of appropriate writ do issue calling the records from the respondent authorities concerned 27 pertaining to case of the petitioner for perusal of this Hon'ble Court, if thinks fit in the facts & circumstances of case. 10.2 A writ and/or an order in the nature of appropriate writ do issue restraining the respondents from the recovery of any loss of paddy due delay in lifting of paddy by the respondent itself and for which loss of moisture the said loss must be counted in driage and further pleased to direct the respondents to consider and decide the representation of the petitioner as per law in the facts and circumstances. 10.3 A writ and/or an order in the nature of appropriate writ do issue restraining the respondents from adopting the unlawful act for the recovery of the loss which is due to the respondents own fault. 10.4 A writ and/or an order in the nature of appropriate writ do -issue directing the respondent to follow the policy framed in this regard for the resolution of the dispute. 10.5 That this Hon'ble court may be further pleased to pass any other consequential and other orders/ writs which this Hon'ble court deems just and proper in the facts and circumstances of the case.” 4. Succinctly stated, the case of the petitioners in this batch of writ petitions is that the petitioner-Societies are Cooperative Societies engaged in procurement of paddy from farmers through their 28 respective Paddy Procurement Centres in accordance with the Paddy Procurement Policy framed by the State Government for the Kharif Marketing Season 2025-2026. The petitioner-Societies, through their Managers/In-charge of the Procurement Centres, were entrusted with the responsibility of purchase, storage and maintenance of the procured paddy stock in terms of the policy and the arrangement made by the respondent authorities. 5. According to the petitioners, after procurement of paddy from the farmers, it was incumbent upon respondent authorities, particularly MARKFED and the concerned District authorities, to ensure timely lifting and transportation of the procured stock from the procurement centres within the period prescribed under the policy. It is the grievance of the petitioners that despite repeated oral and written requests and despite the stock having crossed the buffer limit, the procured paddy was not lifted within the stipulated time and continued to remain stored at the procurement centres/open storage points. 6. As a consequence of such delayed lifting and prolonged storage, the paddy lost moisture on account of natural dryage and climatic conditions, resulting in reduction in weight and consequential shortage in the stock. The petitioners contend that though such shortage was attributable to delayed lifting by the respondent authorities and not to any act or omission on the part of the petitioner-Societies, the respondents have sought to fasten 29 liability upon the petitioners by threatening recovery of the alleged shortage amount and by compelling the petitioners to make good the deficiency. 7. It has further been pleaded that the petitioners had submitted representations to the concerned authorities pointing out that under the policy and the notifications/circulars issued by the State Government, paddy was required to be lifted within the prescribed period and that any loss in weight due to delayed lifting and loss of moisture ought to be considered for exemption/condonation. However, instead of taking steps for condonation/exemption of such loss, the respondent authorities have proceeded to recover the same from the petitioner-Societies and their office bearers, thereby giving rise to the present batch of petitions. 8. Learned counsel appearing for the petitioners would submit that the action of the respondent authorities in seeking to recover the alleged shortage in paddy from the petitioner-Societies is wholly arbitrary, illegal and contrary to the Paddy Procurement Policy governing the field. It is contended that the responsibility of the petitioner-Societies was confined to procurement and safe storage of paddy purchased from the farmers, whereas the obligation of lifting and transportation of the procured stock rested upon respondent authorities such as MARKFED and the concerned District/Marketing authorities. He would submit that 30 despite repeated requests and representations made by the petitioners, the paddy was not lifted within the prescribed time and remained stored for a prolonged period, due to which there was natural loss of moisture and resultant reduction in weight. 9. According to learned counsel, such loss in weight is a natural consequence of delayed lifting and dryage and, therefore, the petitioner-Societies cannot be saddled with liability for the same. It is further argued that the State Government itself had issued directions from time to time requiring timely lifting of paddy and also contemplated that where lifting was delayed beyond the stipulated period, proposal for exemption/condonation of loss in weight due to dryage was required to be processed by the competent authorities. In spite of such policy directions, the respondents, instead of following the prescribed procedure, have resorted to coercive and arm-twisting measures for recovery of the alleged shortage from the petitioner-Societies and their employees. Learned counsel thus submits that the impugned action deserves to be interdicted and the respondents be directed not to recover any amount towards loss caused due to delayed lifting and natural dryage of paddy. 10. Per contra, learned counsel appearing for the State/respondent authorities as well as MARKFED would submit that no case for interference is made out in the present petitions. It is contended that under the Paddy Procurement Policy for the Kharif Marketing 31 Season 2025-2026, there is no automatic provision for grant of dryage benefit in favour of the petitioner-Societies so as to exempt them from shortage found in the stock. It is further submitted that the petitioners, being custodians of the procured paddy at the procurement centres, are responsible for maintaining the stock and any shortage detected in the stock is liable to be accounted for by the concerned Society/In-charge. Learned counsel for the respondents would submit that the petitioners cannot claim a writ of restraint against recovery merely on the basis of a plea of natural dryage, particularly when the policy does not confer any vested right for such exemption as claimed. It is also their submission that the respondents have acted in accordance with the prevailing policy and administrative instructions and, therefore, the petitions, being devoid of merit, deserve to be dismissed. 11. I have heard learned counsel for the parties at length and have perused the pleadings and documents annexed with the respective writ petitions. 12. Upon consideration of the rival submissions and the material placed on record, it appears that the core grievance raised in this batch of petitions pertains to the reduction in weight of procured paddy on account of natural dryage/loss of moisture during the period the stock remained stored at the procurement centres awaiting lifting and transportation by the respondent authorities. 32 The petitioners do not dispute procurement of the paddy or the shortage reflected in the stock; their contention, however, is that such shortage is not attributable to misappropriation or negligence on the part of the petitioner-Societies, but is the direct consequence of delayed lifting by the respondents beyond the period contemplated under the policy. The petitioners have also placed reliance upon the policy provisions and subsequent communications issued by the competent authorities to contend that timely lifting of paddy was obligatory and that where lifting was delayed, the resultant loss in weight due to moisture evaporation was required to be considered for exemption/condonation rather than being recovered from the Societies. Since the controversy essentially turns upon the interpretation of the relevant clauses of the Paddy Procurement Policy and the obligations cast upon the respective stakeholders thereunder, it would be apposite to notice the relevant policy provisions at this stage. Under the Paddy Procurement Policy of the State Government for the Kharif Marketing Session 2025- 2026, there are specific provisions i.e. clause 15.9 and clause 16.3, which address the subject issue and are reproduced below : “15.9 धान उपार्जन के न्द्रों में संग्रहित धान के लिए केई संखत मेंत्रा मेंन्य न गी!। 16.3 धान के पारि$वन  त& निनधारि$त पारि$वनकेत द्व$ पारि$वन न किकेय र्जन पा$ आवश्यकेतन&सं$ 33 स्व!के- त पारि$वन द$ पा$ किकेसं! भी! पारि$वनकेत सं पारि$वन के केय के$य र्ज संकेत 0। मेंके फे ड द्व$ पारि$वन न के$य र्जन के3 स्थिस्5नित में स्व!के- त पारि$वन द$ पा$ संलिमेंनितय द्व$ धान के पारि$वन के$य र्जव । इसं  त& संलिमेंनित उसं धान भीण्ड$ण व सं&$क्षा मेंद अ5व प्रासंगिगीके व्यय के मेंद में प्रादत्त अगिग्रमें $लि? के उपायगी पारि$वन द यके के भी&गीतन  त& के$ संके गी! त5 ऐसं व्यय के3 प्रानितपानित विवपाणन संघ द्व$ संलिमेंनित के के3 र्जएगी!। संलिमेंनितय द्व$ धान पारि$वन के$य र्जन पा$ संग्रण के न्द्रों में धान भीण्ड$ण के$न  त& उगिCत व्यवस्5 मेंके फे ड द्व$ के3 र्जव ।” 13. A perusal of the aforesaid clauses would show that the State Government has framed a Policy, according to which, no dryage is generally permitted. Clause 16.3 provides that in the event MARKFED fails to transport the paddy from the concerned Societies, the Societies themselves are directed to arrange transportation at the applicable rates with the expenses incurred to be subsequently adjusted by MARKFED. Thus, the main ground raised by the petitioner regarding natural dryage caused by delayed transportation cannot be adjudicated by this Court, as doing so would ignore the terms of the subject Policy, which allows no permissible dryage . The petitioner has entered into an 34 Agreement with the respondents, wherein clause 5.6 of the said Agreement stipulates as under : “5.6- foi.ku la?k }kjk iznk; dh xbZ jkf'k ls miktZu dsUnz ¼lfefr½ }kjk /kku foi.ku la?k dks de izkIr gksus ij 'ks"k jkf'k dh olwyh lfefr dks iznk; deh'ku ,oa vU; vuqlkafxd enksa ls jkf'k dh dVkSrh dh tkosxh A blds mijkar Hkh olwyh ;ksX; jkf'k 'ks"k jgus ij ftyk foi.ku vf/kdkjh }kjk N-x- jkT; lgdkjh lkslk;Vh vf/kfu;e 1960 ds varxZr olwyh dk;Zokgh gsrq l{ke U;k;ky; esa izdj.k ntZ fd;k tkosxk A” 14. Likewise, Clause 13 of the Agreement provides the resolution of the disputes between the parties through arbitration, which reads as under: “13- vkfCkZVªs'ku %& bl vuqca/k dh fdlh Hkh df.Mdk ls lacaf/kr fookn mRiUu gksus dh fLFkfr esa fookn ds fu.kZ; gsrq ftys esa ftyk dysDVj dk fu.kZ; vfUre gksxk tks mHk;i{kksa dks ekU; gksxk A dysDVj }kjk fn;s x;s fu.kZ; dh vihy mHk;i{kksa }kjk ftys ds laHkkxh; vk;qDr dks dh tk ldsxh A” 15. Having considered the rival submissions advanced on behalf of the parties, perused the material available on record and examined the Paddy Procurement Policy governing the Kharif Marketing Season 2025-2026, this Court is of the considered opinion that the controversy involved in the present batch of petitions essentially arises out of the obligations and liabilities flowing from the contractual arrangement governing procurement, 35 storage, lifting and transportation of paddy between the petitioner-Societies and the respondent authorities. The principal grievance of the petitioners is with regard to the shortage in paddy allegedly caused on account of delayed lifting, consequential loss of moisture/dryage and the proposed recovery thereof from the petitioner-Societies and their office bearers. Such dispute, in the opinion of this Court, falls squarely within the realm of disputes arising out of implementation of the terms and conditions of the agreement/policy governing procurement operations. Once the agreement itself provides a specific and efficacious dispute resolution mechanism by way of arbitration under Clause 13, this Court is of the view that the petitioners ought to avail the said contractual/statutory remedy for adjudication of their grievances. In such circumstances, this Court is not inclined to entertain the present writ petitions on merits in exercise of its extraordinary jurisdiction under Article 226 of the Constitution of India. 16. Consequently, while declining to examine the merits of the rival claims in the present writ petitions, liberty is reserved in favour of the petitioners to invoke the remedy available under Clause 13 of the agreement and raise all disputes, including the issue relating to alleged shortage in paddy, loss in weight on account of dryage/moisture evaporation, delayed lifting and transportation of paddy, and the legality of the proposed recovery sought to be made from the petitioner-Societies and/or their functionaries, 36 before the competent authority/forum as contemplated under the arbitration clause. 17. 17. It is made clear that if the petitioners invoke the aforesaid remedy and approach the competent authority/forum in terms of Clause 13 of the agreement, the same shall be considered and decided strictly in accordance with law and on its own merits, after affording due opportunity of hearing to all concerned parties. It is further clarified that this Court has not expressed any opinion on the merits of the rival claims, including the entitlement or otherwise of the petitioners to seek condonation/exemption of shortage caused due to delayed lifting and natural dryage of paddy, and all such questions are left open to be adjudicated by the competent authority in the arbitration proceedings. 18. With the aforesaid observations and liberty, all the writ petitions, being this batch of matters, stand disposed of. 19. There shall be no order as to costs.
