The petitioner has filed the present petition and prayed for the following reliefs:- “i. That, the Hon’ble Court may kindly be pleased to call for the record of criminal proceedings in RCC/2326/2026 pending before the Ld. Trial court in the interest of justice; ii. That, this Hon’ble Court may kindly be pleased to quash FIR No.465/2025 dated 22/11/2025 registered at PS Purani Bhilai, Bhilai, Durg for offence under section 420, 406, 34 IPC, along with chargesheet No.64/2026 dated 11/03/2026 and further criminal proceedings in case number RCC/2326/2026 in the matter of “State v. Vikas Mittal & Anr.” arising out of above-mentioned FIR pending before the learned Judicial Magistrate First Class, Bhilai-3, Bhilai, C.G., in the best interest of justice, equity and conscience; Iii. That, this Hon’ble Court may kindly be pleased to take appropriate action against the Station House Officer and Investigating Officer in the FIR No.465/2025 for registering FIR against the Petitioner on complaint of Respondent No.02 despite registration of NCR No.269/2025 dated 30/07/2025 on the same set of facts, evidence and cause of action in the interest of justice, equity and conscience. iv. Any other order(s) and/or direction(s) that the Hon’ble High Court may deem fit in the light of the facts and grounds mentioned in the interest of justice, equity and conscience.” 3 2. In the case at hand, a prayer has been made in the petition for taking action against the Station House Officer. When the query was raised by this Court, it is stated that NCR No.269/2025 was registered and the offence is non-cognizable. The petitioner has come up before this Court for taking action against the Station House Officer including quashing of the proceeding which is pending against him. 3. At this stage, learned counsel for the petitioner seeks permission of the Court to withdraw the instant Petition with liberty to file afresh with proper prayer and pleadings, as and when occasion arises. 4. Accordingly, the instant Petition is dismissed as withdrawn with liberty aforesaid. 5. Certified copy of the impugned order be returned to learned counsel for the petitioner after retaining xerox copy of the same.
