Petitioner’s case for grant of the benefit under the 4- 9-14 Assured Career Progression Scheme (ACPS), on completion of four years of service by her, has been turned down by respondent No. 3 vide order dated 03.03.2026 (Annexure P-4), hence, the present writ petition.

Learned counsel for the petitioner submits that the benefit claimed by the petitioner has been turned down by the respondents only on the ground that the petitioner had been granted financial upgradation. Learned counsel further submits that the grievance of the petitioner and the issue raised herein

2 have already been adjudicated upon in Sanjay Kumar Vs. State of H.P. & Ors.2 Learned counsel also submitted that the petitioner would be content in case a direction is issued to the respondents/competent authority to consider and decide the case of the petitioner for redressal of her grievances raised in the writ petition in light of the aforesaid judgment within a fixed time schedule. Learned Additional Advocate General is not averse to this prayer.

Having regard to the aforesaid submissions, but without examining the merits of the matter, the present writ petition is disposed of by directing respondent No. 2/competent authority to reconsider the case of the petitioner for grant of the benefit upon completion of four years of service under the 4-9-14 ACPS, notwithstanding the order dated 03.03.2026 (Annexure P- 4), in accordance with law and after taking into consideration the aforesaid judgment, within a period of six weeks from today. The decision so arrived at shall also be communicated to the petitioner. Pending miscellaneous application(s), if any, also to stand disposed of.
