JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioners are before this Court calling in question proceedings in C.C.No.56006/2023, pending before the XXIX Addl. Chief Metropolitan Magistrate, at Mayohall, Bengaluru City, for the offences under Sections 498A, 504, 506 read with 34 of the Indian Penal Code and Sections 3 and 4 of the Dowry Prohibition Act. - 3 - HC-KAR NC: 2026:KHC:30589 WP No. 27229 of 2023 2. Heard Sri.Pradeep H.S., learned counsel appearing for the petitioners, Smt.Rashmi Patel, learned HCGP appearing for respondent No.1, Sri.K.K.Vasanth, learned counsel appearing for respondent No.2 and have perused the material on record. 3. During the pendency of the proceedings, the parties to the lis have settled the dispute among themselves and have filed a Joint Memo in that regard. The said Joint Memo reads as follows: “1. The petitioner No.1 (Accused No.2) is the mother in law and the petitioner No.2 (Accused No.3) is the brother in Law of the Respondent No.2. The petitioners have filed this petition before this Hon'ble Court for quashing the charge sheet and entire proceedings in C.C. No. 56006/2023 registered by Respondents No.1 / Marathahalli Police station for the commission of the alleged offences punishable under Sections 498A, 504, 506 r/w 34 of I.P.C and section 3 and 4 of the D.P. Act on the file of the XXIX ADDL. METROPOLITAN MAGISTRATE, AT MAYOHALL, BENGALURU CITY, wherein this Hon'ble Court has passed the interim order by staying further proceedings in C.C. No. 56006/2023 against the petitioners. 2. That during the pendency of this petition due to the intervention of the family members and well-wishers of the petitioners and the respondent No.2 have sought out their difference and resolved their dispute. Accordingly, the son (Accused No.1) of the petitioner No.1 and the respondent No.2 agreed to live separately by dissolving their marriage. 3. The son of the petitioner No.1 / Accused No.1 is agreed to pay a sum of Rs. 11,00,000/- (Rupees Eleven Lakh only) to the - 4 - HC-KAR NC: 2026:KHC:30589 WP No. 27229 of 2023 respondent No.2 towards her permanent alimony. On the other hand, the respondent No.2 has also agreed for the same and also agreed to cooperate to the petitioners to close or quash the charge sheet and proceedings in C.C.No.56006/2023 which is filed against the petitioners in the present petition before this Hon'ble Court. 4. The Son of petitioner No.1 and the respondent No.2 in view of the aforementioned terms have filed the petition before the Hon'ble II Addl. Judge Family Court at Bengaluru under Section 13 (B) of Hindu Marriage Act for divorce by mutual consent on 22.11.2025 and also filed the application for dispensation of cooling period. The said application is allowed and the matter was referred to mediation. 5. The Son of petitioners paid sum of Rs. 6,00,000/- to the Respondent No.2 by way of D.D. bearing No. 744332 dated 12.01.2026 drawn on IDFC FIRST BANK, AECS Layout, Bengaluru on 12.02.2026 before family court and agreed to pay the balance Rs. 5,00,000/- before this court at the time of disposal of the petitions and both parties also signed the mediation settlement agreement. On the basis of the said mediation settlement agreement the Hon'ble Family Court dissolved the marriage between son of the petitioner and Respondent No.2 and granted the decree of divorce by its order dated on 12.02.2026. 6. The petitioners and the respondent No.2 jointly and voluntarily filing this Joint memo to quash the charge sheet and entire proceedings in C.C. No. 56006/2023 registered by Respondents No.1 / Marathahalli Police station for the commission of the alleged offences punishable under sections 498A, 504, 506 r/w 34 of I.P.C and section 3 and 4 of the D.P. Act on the file of the XXIX ADDL. METROPOLITAN MAGISTRATE, AT MAYOHALL, BENGALURU CITY against the petitioners. Wherefore, the petitioners and the respondent No.2 humbly prays that this Hon'ble Court to quash the charge sheet and entire proceedings in C.C. No. 56006/2023 registered by Respondents No.1 / Marathahalli Police station for the commission of the alleged offences punishable under sections 498A, 504, 506 r/w 34 of I.P.C and section 3 and 4 of the D.P. Act on the file of the XXIX ADDL. The parties to the lis are present before the Court and are identified by their respective counsels. 5. Learned counsel appearing for the petitioners submits that demand draft of Rs.5,00,000/- is paid to the counsel for the respondent No.2, the same is acknowledged by the respondent No.2 who is present before the Court. 6. In the light of Joint Memo as quoted supra being filed by the parties to the lis and offences not being against the State, I deem it appropriate to accept the Joint Memo and terminate the proceedings against the petitioners in the subject petition. 7.
