W.P.No.38936_2013 ORDER:
1.
The petitioner has challenging the appointment of respondent No. 4 to the post of Anganwadi Teacher. It is stated in the writ petition that the petitioner had applied for the said post pursuant to the notification dated
12.01.2011. 2. It is stated that the petitioner secured 314 marks in the SSC examination, whereas respondent No. 4 secured only 289 marks in the SSC examination. However, respondent No.4 was preferred by respondent Nos.1 to 3 for appointment to the post of Anganwadi Teacher. The petitioner claims that, on account of securing higher marks in the SSC examination, she is entitled to be appointed as an Anganwadi Teacher. 3. A perusal of the notification indicates that SSC is prescribed as a qualification, along with several other criteria. The notification does not provide for awarding additional weightage on the basis of higher marks obtained in the SSC examination. It merely prescribes passing the SCC examination as one of the eligibility criteria. All candidates who have passed the SSC examination are to be awarded equal marks in that regard. 4. The respondents have identified respondent No. 4 as a suitable candidate based on the applicable selection criteria and have accordingly issued the appointment orders. 4

W.P.No.38936_2013
5. This Court has, in several earlier writ petitions, considered similar cases wherein the petitioners challenged the appointment of unofficial respondents on the ground that the petitioners had secured higher marks in the SSC examination. However, the respondent authorities preferred appointing the unofficial respondents. This Court, in those matters, rejected the claims of the petitioners therein and upheld the appointments, observing that the Selection Committee had awarded marks to the candidates after duly considering all the prescribed criteria. 6. On these grounds, this Court finds no grounds to interfere with the appointment of respondent No.4. Accordingly, the writ petition stands closed. There shall be no order as to costs. Pending miscellaneous petitions, if any, shall stand closed. ___________________ JUSTICE HARINATH.N Date:17.02.2026 NKA
