JUSTICE RAVI V HOSMANI - 3 - HC-KAR NC: 2026:KHC:31557 CRL.P No. 8469 of 2019 ORAL ORDER This petition is filed challenging entire proceedings in CC no.10675/2018 in Crime no.184/2014 on file of I ACMM, Bengaluru. 2. Smt.Chethana Manjunath, learned counsel appearing for BS Manjunath counsel for petitioners submitted that facts involved in present case as well as grounds of challenge of proceedings were same as in Crl.P.no.1808/2019 (S N Prakash) allowed by this Court on 07.04.2026, but in respect of accused no.2. It was submitted that allegations against petitioners-accused no.3 and 6 were same as in case of accused no.2 and there were no allegations against petitioner no.3-accused no.9 without any specific allegation. Relying on decision in SN Prakash's case (supra), learned counsel prays for allowing petition. 3. Learned HCGP for respondent-State as well as Sri Rohan, appearing for MR Balakrishna, learned counsel for respondent no.2 are unable to counter submission of learned counsel for petitioners. - 4 - HC-KAR NC: 2026:KHC:31557 CRL.P No. 8469 of 2019 4. Heard learned counsel and perused material on record as well as judgment passed in SN Prakash's case. 5. On finding that proceedings insofar as accused no.2 were quashed and allegations sofaras accused no.3 and 6 are same and without any overt acts, insofar as accused no.9, continuation of proceedings against petitioners - accused no.3, 6 and 9 would be abuse of process. 6. Hence, petition is allowed, proceedings in CC no.10675/2018 in Crime no.184/2014 on file of I ACMM, Bengaluru, against accused no.3, 6 and 9 are quashed.
