02/27.08.2026 Heard learned counsel for the petitioner and learned counsel for the State.
2. The petitioner is apprehending his arrest in connection with N.D.P.S. Case No.6 of 2026 arising out of N.D.P.S. (Khunti) P.S. Case No.4 of 2026 registered for the offence under Sections 18(b) of N.D.P.S. Act, pending in the court of learned Special Judge, N.D.P.S., Khunti.

Learned counsel appearing for the petitioner submits that the petitioner has been falsely implicated in the case alleging that the petitioner was involved in cultivation of opium plant. He submits that the place of occurrence is open space and the land in question not belonging to the petitioner and that has been disclosed in para 12 of the petition. He also submits that initially the FIR is registered against unknown and only on the basis of satellite image, the name of the petitioner has been implicated. He next submits that the petitioner is having no criminal antecedent as disclosed in para 15 of the petition.

Learned counsel appearing for the State opposes the prayer and submits that the allegations are there of cultivation of opium on the forest land.
5. In the FIR, the petitioner is not named and it has also been stated that the said land is situated in forest, however, the allegation is made that the land belongs to the petitioner and that has been denied in para 12 of the petition and the petitioner is having no criminal antecedent
2026:JHHC:25774 as disclosed in para 15 of the petition, in the attending facts and circumstances, I am inclined to grant anticipatory bail to the petitioner.

Accordingly, the above-named petitioner is directed to surrender before the learned court within three weeks from today and in the event of his arrest or surrender, he shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, N.D.P.S., Khunti, in connection with N.D.P.S. Case No.6 of 2026 arising out of N.D.P.S. (Khunti) P.S. Case No.4 of 2026, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
