Sabeer Mohamad and Ors. vs. State of H.P. and Ors. CWPOA No.5718 of 2019 23.09.2026 Present: Mr. Sanjeev Bhushan, Senior Advocate with Mr.Rajesh Kumar, Advocate for the petitioners. Mr. Rupinder Singh Thakur, Additional Advocate General for respondents 1 to 7 & 9-State. CMP-T No.433 of 2026 The applicants/petitioners, by way of present application have prayed for staying the order dated 03.09.2026, passed by respondent No.8 at the instance of respondent No.3. 2. It has been averred in the application that the petitioners are working as Data Entry Operator/Junior Office Assistants (IT) on outsource basis for more than a decade now and had approached this Court seeking the relief of regularisation and are fighting for their rightful claims since 2015. It has also been averred that when the matter was listed before the erstwhile Himachal Pradesh Administrative Tribunal on 15.10.2015, an interim order was passed to the effect that the services of the applicants/petitioners be not terminated and they may be allowed to continue. Since the applicants/petitioners are continuing on the strength of the said order passed by the learned Tribunal, in the interest of justice, the order dated 03.09.2026 passed by respondent No.8 is ordered to be stayed and the applicants/petitioners are allowed to continue serving respondent No.3 as Data Entry Operator/Junior Office Assistants (IT) as they were prior to the passing of the order dated 03.09.2026. The application stands disposed of. CMP-T No.446 of 2026 Applicants/respondents No.2 to 4 have filed an application for early hearing of main petition. Keeping in view the fact that the applicants/petitioners have filed the original application in the year 2015, the same is allowed and accordingly disposed of. CWPOA No.5718 of 2019 List for hearing on 14th October, 2026. 23rd September, 2026 ( Jiya Lal Bhardwaj ) (naveen) Judge
