2026:HHC:41386 IN THE HIGH COURT OF HIMACHAL PRADESH, SHIMLA
Review Petition No.104 of 2026 Decided on: 25.09.2026 Ajay Kumar … Petitioner Versus The State of Himachal Pradesh and others … Respondents Coram Hon’ble Mr. Justice Ajay Mohan Goel, Judge. Whether approved for reporting?1 ____________________________________________________
_
For the petitioners: Ms. Vijayaini Sharma, Advocate. For the respondents: Mr. Rajat Chauhan, Assistant Advocate General, for respondents No.1 to 4. Ajay Mohan Goel, Judge (Oral) By way of this review petition, the petitioner is seeking the review of order dated 11.08.2026, passed by this Court, on the grounds that have been urged in it. 2. Having heard learned Counsel for the review petitioner and having perused the order in issue, this Court has no hesitation in holding that by way of this review petition, now the petitioner intends to espouse a totally new case in this Court, which is no ground to seek a review of the order. This is more so in light of the fact that the petition was not disposed of by this Court by passing any order on merit, but it was disposed of in light of the request that was made on behalf of the petitioner through his learned counsel. To be more specific, paragraphs 3 and 4 of the order, review whereof is being sought, are quoted hereinbelow:-
“..3. In the light of this reply, Mr. Javed Khan, learned 1 Whether reporters of the local papers may be allowed to see the judgment? 2 2026:HHC:41386 counsel for the petitioner submits that respondents be directed to ensure that as and when a demand for filling up a post of PGT Economics is received by respondent No. 2, it will forthwith sponsor the name of the petitioner because the said respondent cannot now be permitted to resile from the fact that the petitioner, since the year 2021, is at serial number 1 in the waiting panel of OBC category. 4.
In the light of the reply filed by respondent No. 2, as the request made on behalf of the petitioner is a genuine request, this petition is disposed of with the direction that as and when a requisition is received by respondent No. 2 qua a post of OBC category of PGT Economics, the name of the petitioner be sponsored in the light of the contents of para-2 of the reply, in terms whereof he is at serial number 1 of the waiting panel of OBC category candidate for the post of PGT (Economics).” [
3. A perusal of these two paragraphs clearly demonstrates the mode and manner in which the petition was disposed of and it was on the express asking of the learned Counsel for the petitioner that the petition be disposed of in a manner. 4. Therefore, obviously as there is no error apparent on the face of the record, present petition is dismissed, so also pending miscellaneous application(s), if any. (Ajay Mohan Goel)
