For Non-Applicant(s) : Mr. Shailendra Sharma, Panel Lawyer. Hon'ble Mr. Ramesh Sinha, Chief Justice Order on Board 01.07.2026 1. This is the first bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 97/2025 registered at Police Station Singhoda, District - Mahasamund (C.G.), for the offence punishable under Sections 20(B) and 29(1) of the Narcotic Drugs and Psychotropic Substances Act, 1985. 2. As per the prosecution story, in brief, the concerned Police Station, Singhoda, received secret information from an informant that, at the time of the incident, certain unknown persons were illegally keeping contraband ganja in their possession for the purpose of sale. Acting upon ABHISHEK SHRIVAS Digitally signed by ABHISHEK SHRIVAS Date: 2026.07.03 11:06:19 +0530 2 the said information, the police allegedly seized 50 kg of contraband ganja from an open place, which is alleged to have been in the possession of the applicant. As a result thereof, the police registered an offence punishable under Sections 20(b) and 29(1) of the N.D.P.S. Act against the accused persons, and the present applicant was arrested on 20.01.2026 only on the basis of the memorandum statement of the co- accused. 3. Learned counsel for the applicant would submit that the applicant has been falsely implicated in this case. He submits that the applicant never involved in any commission of crime as the contraband psychotropic substance was not seized from the exclusive possession of applicant and only on the basis of memorandum of co-accused applicant has been roped as accused in the present case. He also submits that the present applicant has been in jail since 20.01.2026, conclusion of the trial may take quite long time. Accordingly, he prays for enlarging the applicant on regular bail. 4. Learned counsel appearing for the State/non-applicant opposes the bail application and submits that the charge-sheet has been filed before the competent Court in the present case. He further submits that the co- accused, namely, Kushal Singh, was allegedly transporting 50 kg of Ganja, which is much above the commercial quantity. The name of the present applicant came to light on the basis of the memorandum statement of the said co-accused, Kushal Singh, indicating that the offence is part of an organized crime. Therefore, the applicant is not entitled to be released on bail. 5. I have heard learned counsel appearing for the parties and perused the case diary. 3 6. Considering the overall facts and circumstances of the case, particularly the allegation that the co-accused, Kushal Singh, was apprehended while transporting 50 kg of Ganja, which is much above the commercial quantity, and that the name of the present applicant surfaced during the investigation on the basis of the memorandum statement of the co- accused, prima facie indicating his involvement in the commission of the offence, indicating that it is an organized crime, therefore, I am not inclined to grant regular bail to the present applicant. 7. Accordingly, the bail application of the applicant - Raghvendra Singh, involved in Crime No. 97/2025 registered at Police Station Singhoda, District - Mahasamund (C.G.), for the offence punishable under Sections 20(B) and 29(1) of the Narcotic Drugs and Psychotropic Substances Act, 1985, is rejected. 8.
