The petitioner is apprehending his arrest in connection with Katras P.S. Case No. 328 of 2024, registered for the offence under Sections 197(2), 126(2), 352, 115(2), 118(1), 117(2) and 109(1) of Bhartiya Nyaya Sanhita, 2023, pending in the court of learned Sub Divisional Judicial Magistrate, Dhanbad. 3. Learned counsel appearing for the petitioner submits that the petitioner’s brother is a member of Zila Parishad and for that due to enmity, the petitioner has been falsely implicated in the case. She submits that although allegations are there of assault by knife, however, in para 19 of the case diary, two of the witnesses examined under Section 180 of the BNSS, have not supported the allegation of assault by knife. She further submits that one of the co-accused has been granted anticipatory bail in A.B.A. No.3558 of 2026. 4. Learned counsel appearing for the State opposes the prayer and submits that the allegations are there of assault by knife. 5. Considering that the witnesses examined under Section 180 of the BNSS have not supported the assault by knife which has come in the case diary as submitted by the learned counsel for the petitioner and one of the co-accused has been granted anticipatory bail in the aforesaid A.B.A., in 2026:JHHC:26009 the attending facts and circumstances, I am inclined to grant anticipatory bail to the petitioner. 6. Accordingly, the above-named petitioner is directed to surrender before the learned court within three weeks from today and in the event of his arrest or surrender, he shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Dhanbad, in connection with Katras P.S.
