ORAL ORDER
1. Accused nos.3 and 4 in Crime No.119 of 2026 registered by Sira Police Station, Tumakuru District, for offences punishable under Sections 115(2), 118(1), 351(2), 352, 74, R/w Section 3(5) of BNS, 2023 are before this Court in this petition filed under Section 482 of BNSS, 2023 seeking anticipatory bail. 2. FIR in Crime No.119 of 2026 registered by Sira Police Station, Tumakuru District, for the aforesaid offences against one Ranganna and three others, based on the first information dated 03.04.2026 received from Sri Bhutharaju, who is the son of injured victims in the present case. Petitioners herein are the son and wife of accused no.1 - Ranganna. Apprehending arrest in the case, they had filed Crl.Misc.No.565 of 2025 before the jurisdictional Sessions Court which was rejected on 21.04.2026. Therefore, they are before this Court. - 3 -

3. Perusal of the material on record would go to show that, alleged incident in question had taken place on
25.03.2026. First information was submitted in the present case on 03.04.2026 by the son of the injured victims. He has alleged that in the incident that had taken place on 25.03.2026, accused nos.1 to 4 had abused and assaulted his parents, who have suffered grievous injuries. Accused no.1 is the father of accused nos.2 and 3 and husband of accused no.4. 4. In respect of the very same incident a counter case is registered in Crime No.123 of 2026 by the very same police station, based on the first information dated 04.04.2026, submitted by Smt. Gayathri who is the wife of the second accused in the present case. In the said case, the injured and the first informant of the present case are arraigned as accused nos.1 to 3. In the first information submitted in Crime No.123 of 2026, the presence of the petitioners herein at the spot of crime is not mentioned. Though the presence of accused nos.1 and 2 in the present case is mentioned there is no serious allegation as against the accused no.4 in the present case. The accused nos.2 and 3 are the sons of the accused no.4. - 4 -

Chances of implicating the petitioners herein in the belated complaint which was filed after a period of 7 days from the alleged date of incident cannot be ruled out. Petitioners have undertaken to cooperate with the police for the purposes of investigation. 6. Accordingly, the following:
ORDER The Criminal Petition is allowed. The respondent - Police or any other police in the State of Karnataka are directed to release the petitioners in the event of their arrest in Crime No.119 of 2026 registered by Sira Police Station, Tumakuru District, for offences punishable under Sections 115(2), 118(1), 351(2), 352, 74, R/w Section 3(5) of BNS, 2023, subject to the following conditions:
1. The petitioners shall appear before the Investigating Officer in the present case within a period of fifteen days from the date of receipt of certified copy of this order on executing a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) each with two sureties for the likesum to the

satisfaction of the investigating officer/jurisdictional Court.
2. The petitioners shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons.
3. The petitioners shall not tamper with the prosecution witness and they shall co-operate with the Police for investigation and appear before them whenever called upon.
4. The petitioners shall not involve in similar offences in future.
