Learned counsel for the petitioner submits that the petitioner is in custody since 19.03.2026 in connection with Kunda P.S. Case No.16/2026, corresponding to POCSO Case No.48/2026, registered under Sections 65 (2) of the Bharatiya Nyaya Sanhita, 2023 and Section 4, 6 of POCSO Act. It is submitted that after submission of the charge-sheet, cognizance was taken on 16.05.2026 for offences under Section 65(2) of the BNS, 2023 and Section 6 of the POCSO Act, and the case is pending in the court of learned Additional Sessions Judge-cum-Special Judge (POCSO), Chatra. 3. Learned counsel for the petitioner submits that the petitioner, aged about 55 years, is in custody since 19.03.2026 and charges have been framed for the alleged offences under Section 65(2) of BNS, 2023 and Section 4/6 of the POCSO Act. 4. Upon a query of this Court, the learned counsel submits that the victim is aged 9 years and that the petitioner is her cousin grandfather. 5. The learned counsel for the State has opposed the prayer for bail and submitted that there is direct and specific allegation against the petitioner, and therefore, the petitioner may not enlarge on bail. 6. After hearing the learned counsel for the parties and considering the direct allegations against the petitioner which is supported by the 9-year-old victim in her statement recorded under Section 183 of the BNSS, wherein she has fully supported the 2026:JHHC:25816 2 prosecution case, this Court is not inclined to enlarge the petitioner on bail.
