THIS PETITION, COMING ON FOR ORDERS, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MRS. JUSTICE P SREE SUDHA ORAL ORDER Heard the arguments of learned counsel for the petitioner. 2. This transfer petition is filed by the wife for transfer of M.C.No.18/2025 filed by the husband for restitution of conjugal rights before the Senior Civil Judge and JMFC, Mulbagal after filing of divorce by her in M.C.No.770/2024 before the I Additional Family Court Judge, Mysuru. 3. The distance between Mulbagal and Mysuru is 242 kms. She is residing with her parents and practicing as an - 3 - HC-KAR NC: 2026:KHC:29532 CP No. 356 of 2025 Advocate. She is having a minor child aged one and half years. She has filed an application claiming maintenance. An interim order granting of ₹20,000/- was challenged by the respondent in W.P.No.24409/2025 and it is still pending. Respondent is a Software Engineer and he is residing at Mulbagal. 4. Considering the fact that the petitioner is having a minor child and also the fact that she has filed divorce petition initially and later, restitution of conjugal rights is filed by the husband and the fact that both the matters are to be tried together to avoid conflicting of judgments. This Court finds that it is just and reasonable to transfer M.C.No.18/2025 filed by the husband for restitution of conjugal rights from the Senior Civil Judge and JMFC at Mulbagal to I Additional Family Court at Mysuru to try along with M.C.No.770/2024.
