JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioner is before this Court calling in question proceedings in Crime No.218/2023, pending before I Addl. Civil Judge (Jr. Dn) and J.M.F.C. Court, Tumakuru District, for the offences under Sections 406, 420, 504, 506 of Indian Penal Code. 2. Heard Smt.Vijetha R Naik, learned counsel appearing for the petitioner, Smt.Rashmi Patel, learned HCGP appearing for respondent No.1, Sri. Harsha Veerangouda, - 3 - HC-KAR NC: 2026:KHC:30612 CRL.P No. 9192 of 2023 learned counsel appearing for respondent No.2 and have perused the material on record. 3. During the pendency of the proceedings, the parties to the lis have settled the dispute among themselves and have filed a compounding application along with the joint affidavit. The compounding application reads as follows: “1. The Petitioner states that the instant petition is filed seeking quashing of the FIR in Crime No. 218/2023 of the Respondent Tumakuru Rural Circle Police Station registered for the offences punishable under sections 406, 420, 504 and 506 of the Indian Penal Code pending on the file of I Additional Chief Civil Judge (Junior Division) and JMFC Court, at Tumkuru registered against the Petitioner herein. 2. The Petitioner states that due to the intervention of the elders and well-wishers, the Respondent No.2 is no longer interested in prosecuting the criminal case against the Petitioner i.e, in Crime No. 218/2023 of the Respondent Tumakuru Rural Circle Police Station registered for the offences punishable under sections 406, 420, 504 and 506 of the Indian Penal Code pending on the file of I Additional Chief Civil Judge (Junior Division) and JMFC Court, at Tumkuru and has admitted that he has registered the impugned crime at the behest of Respondent No.3. 3. The Petitioner states that it is agreed that the Respondent No. 2 (who had registered the impugned crime) would not prosecute the instant criminal case and hence the Respondent No. 2 has no objections for quashing, closing, compounding of the FIR in Crime No. 218/2023 of the Respondent Tumakuru Rural Circle Police Station registered for the offences punishable under sections 406, 420, 504 and 506 of the Indian - 4 - HC-KAR NC: 2026:KHC:30612 CRL.P No. 9192 of 2023 Penal Code pending on the file of I Additional Chief Civil Judge (Junior Division) and JMFC Court, at Tumkuru. WHEREFORE, the Petitioner and the Respondent No. 2 humbly prays that this Hon'ble Court be pleased to permit the Petitioner and the Respondent No.2 to compound the offences as alleged against the Petitioner and further to quash the Crime No. 218/2023 of the Respondent Tumakuru Rural Circle Police Station registered for the offences punishable under sections 406, 420, 504 and 506 of the Indian Penal Code pending on the file of I Additional Chief Civil Judge (Junior Division) and JMFC Court, at Tumkuru.” 4. The parties to the lis are present before the Court and are identified by their respective counsels. 5. In the light of application for compounding being filed along with the joint affidavit and offences not being against the State, I deem it appropriate to accept the compounding application and terminate the proceedings against the petitioner in the subject petition. 6.
