Yes. 2 3. In view of above, present revision petition is allowed and the judgment passed by learned Additional Sessions Judge, Rohru, District Shimla, H.P. (learned appellate Court) in Criminal Appeal No. 192 of 2024, decided on 10.07.2024, affirming the judgment of conviction and order of sentence dated 29.02.2024, passed by learned Additional Chief Judicial Magistrate, Court No.1 Rohru, District Shimla, H.P. in Criminal Case No. 59-3 of 2020 are ordered to be set aside and the complaint is dismissed as not pressed. 4. Learned counsel for the petitioner submits that no amount deposited before the learned Courts below or before this Court. 5. Learned counsel for the petitioner submits that the accused/petitioner is lodged in Model Central Jail Kanda, , Shimla, District Shimla. The petitioner is ordered to be released forthwith, if not required in any other case. 6. Release warrants be prepared accordingly and the same be sent to the Jail Superintendent, Model Central Jail Kanda, Ghanahatti, Shimla, District Shimla and learned Trial Court through FASTER forthwith for necessary compliance. 3 7.
