Vivek Singh Thakur, Judge (Oral) This revision has been preferred against order dated 21.09.2024, passed by learned Additional Principal Judge, Family Court, Hamirpur, (H.P.), Circuit Court at Barsar in filing registration No. 140 of 2019, titled Arpita Kumari vs. Arun Thakur, whereby the petition preferred by the petitioner has been allowed by awarding monthly maintenance at the rate of Rs.8,000/- per month payable by the respondent, but from the date of order instead of the date of filing of the petition by the petitioner before the Family Court.

Though, in the petition, the prayer for enhancing the monthly maintenance to the tune of Rs.20,000/- per month has also been made, however, keeping in view the facts and circumstances and the material placed before us as well as
submissions made by learned counsel for the parties, we are not inclined to enhance the amount of maintenance in this petition, however, keeping the right of the petitioner open to file appropriate application/petition for enhancing the amount of maintenance, if so desired and required in the given facts and/or otherwise, by availing the appropriate remedy for enhancement of maintenance.

Considering the submissions made by learned counsel for the parties, we are of the considered opinion that awarded monthly maintenance at the rate of Rs.8,000/- per month payable by the respondent to the petitioner should have been granted from the date of filing of the petition i.e.
09.05.2019.

Accordingly, impugned order dated 21.09.2024 is modified to the extent that maintenance at the rate of Rs.8,000/- per month shall be payable by the respondent to the petitioner from the date of filing of the petition before the

learned Family Court i.e. 09.05.2019. Rest of the order remains the same.

Considering the request made by learned counsel for the respondent, the respondent is directed and permitted to pay the arrears of maintenance in three equal instalments i.e. 30% of the arrears of maintenance shall be paid on or before 30th April, 2026, 2nd instalment of 30% of arrears of maintenance on or before 30th June, 2026 and balance 40% of arrears of maintenance on or before 31st August, 2026, with further direction that the respondent shall continue to pay future maintenance on or before 7th of each month, for which the maintenance shall be due, failing which, the aforesaid time granted to pay the arrears of maintenance, shall stand modified and petitioner shall be at liberty to take appropriate recourse of law to recover the same immediately after default in making the future maintenance amount.

In view of above, the revision petition is disposed of, so also the pending application(s), if any. [[
