JUSTICE S VISHWAJITH SHETTY ORAL ORDER Accused Nos. 1, 2 and 6 in Crime No.127/2026 registered by Bharamasagara Police Station, Chitradurga for offences punishable under Sections 312 and 324(4) of BNS, 2023 are before this Court in these two petitions filed under Sections 483 of BNSS, 2023 and 482 of BNSS, 2023, seeking regular bail and anticipatory bail, respectively. 2. Heard the Learned counsel for the parties. 3. FIR in Crime No.127/2026 was registered by Bharamasagara Police Station, Chitradurga, for the aforesaid offences against Odivelu and others based on - 4 - HC-KAR NC: 2026:KHC:31681 CRL.P No. 6004 of 2026 C/W CRL.P No. 6017 of 2026 the first information dated 21.03.2026 received from Pappanna, S/o.Gadarappa. During the course of investigation, accused Nos. 1 and 2 were arrested on 21.03.2026 and remanded to judicial custody. Their bail application filed before the jurisdictional Sessions Court in Cr.Misc.No.313/2026 was rejected on 02.04.2026. Therefore, they are before this Court in Crl.P.No. 6004/2026. 4. Accused No.6 in Crime No.127/2026 had approached the jurisdictional Sessions Court in Crl.Misc.No.336/2026 apprehending arrest in the said case. The learned Sessions Judge, by order dated 08.04.2026 had dismissed Crl.Misc.No.336/2026. Therefore, accused No.6 is before this Court in Crl.P.No. 6017/2026, seeking anticipatory bail. 5. In the first information which is filed by Pappanna on 21.03.2026, he has stated that he is working as a gardener in the farmhouse of one Sri Devendrappa. On 20.03.2026 at about 08.00 p.m. when he was sitting - 5 - HC-KAR NC: 2026:KHC:31681 CRL.P No. 6004 of 2026 C/W CRL.P No. 6017 of 2026 outside the farmhouse, about 7 to 8 persons wearing masks on their face, armed with weapons, came there and asked him to hand over the keys. Thereafter, they allegedly broke open the door of the house and searched for valuables in the house. Since they did not get anything inside the house they allegedly broke the window pans of the house and thereafter escaped. Since one of them allegedly removed his mask while escaping, first informant had identified him and therefore, FIR was registered against Odivelu and others in Crime No.127/2026. 6. Accused No.1 Odivelu and accused No. 2 Raja, are in custody in the present case from 21.03.2026 onwards. Investigation in the case is already completed and charge sheet is filed. Petitioners do not have criminal antecedents. Accused Nos.3 and 4 have been granted anticipatory bail by this Court in Crl.P.No.5626/2026 disposed of on 12.06.2026. Under the circumstances, I am of the opinion, prayer made by the petitioners who have - 6 - HC-KAR NC: 2026:KHC:31681 CRL.P No. 6004 of 2026 C/W CRL.P No. 6017 of 2026 no criminal antecedents needs to be granted. Accordingly, following: ORDER Crl.P.No.6004/2026 is allowed. The petitioners are directed to be enlarged on bail in Crime No.127/2026 of Bharamasagara Police Station registered for the offences punishable under Sections 312, 324(4) of BNS 2023, subject to the following conditions: a) Each of the petitioners shall execute personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioners shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts their appearance for valid reasons; - 7 - HC-KAR NC: 2026:KHC:31681 CRL.P No. 6004 of 2026 C/W CRL.P No. 6017 of 2026 c) The petitioners shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioners shall not involve in similar offences in future; Crl.P.No.6017/2026 is allowed.
