Issue notice. Mr. Pushpinder Jaswal, learned Additional Advocate General, accepts notice on behalf of the respondents.

The petitioner is aggrieved by the fact that in terms of Annexure P-5, his request for now being accommodated at the station of his choice stands rejected by the Authority, ignoring the fact that as the petitioner has completed the normal tenure in a tribal area, he is entitled for posting at the station of his choice.

Petitioner is called upon to furnish five stations of his choice to the authority within one week from today and appropriate call be taken thereupon by the Authority within two
weeks thereafter, and the result thereof be intimated to the Court on the next date of hearing. The counsel of the petitioner on behalf of the petitioner may file a representation. This liberty is being granted in the present case as the petitioner is stated to be presently serving at Bharmour and it will not be in the interest justice to ask the petitioner to visit Shimla for this limited purpose.

This Court makes it clear that the factum of the vacancy being available as also the incumbency of the persons presently holding the post shall be taken into consideration while considering the request of the petitioner.

Pending miscellaneous applications, if any, also stand disposed of.
