Learned counsel for the petitioner fairly submits that, against the order passed by the concerned Tahsildar, the petitioner has already preferred an appeal under Section 44(1) of the Chhattisgarh Land Revenue Code before the competent Sub- Divisional Officer (Revenue), and the said appeal is presently pending for consideration and as such learned counsel for the petitioner seeks permission of this Court to withdraw this petition 3 with liberty to pursue the appeal which is pending before the concerned SDO ( R ). 3.
