JUSTICE M.NAGAPRASANNA ORAL ORDER Petitioners – accused Nos.1 and 2 are before this Court calling in question registration of a crime in Crime No.523/2010, pending before the X Additional Chief Judicial Magistrate, Mayo Hall, Bengaluru City, for the offences under Sections 447, 341, 323, 427, 379, 504 and 506 of the IPC. 2. Learned counsel for the petitioners and respondent No.2 in unison would submit that during the subsistence of these proceedings, the parties to the lis have entered into settlement amongst themselves by drawing up certain terms and conditions. The parties file a joint memo of settlement and an affidavit, both executed at Delhi, before this Court seeking permission to compound the afore-quoted offences. 3. The joint memo of settlement reads as follows: “WHEREAS at the intervention of the elders and well-wishers on both sides, both the parties have agreed to settle the disputes in full and final on the following terms and conditions: 1. In the view of the detailed deliberation among the parties, it is agreed that both the parties withdraw their respective allegations made in the above complaint/cases or in any other suit or elsewhere against each other. - 4 - HC-KAR NC: 2026:KHC:28632 CRL.P No. 8309 of 2025 2. In view of the settlement arrived at amongst the parties the Complaint/cases that are pending amongst the parties as mentioned in Para A will be withdrawn or shall be co- operated by both parties to withdraw. 3. It is agreed amongst the parties that M/s Carpenters Classic Exim Pvt., Ltd., represented by the Second Party shall appear in the Hon'ble High Court of Karnataka, Bengaluru, through personally or their lawyer after filing an original copy of this Joint Memo of Settlement and there- after submitting in the Court that the dispute is resolved and agreeing/accepting the quashing of the proceedings in Criminal Petition No.8309/2025 and thereby leading to the quashing the proceeding in CC No.51440/2024 on the file of the X Addl. Chief Judicial Magistrate, Mayo Hall. As also Misc. No.59/2019 before the XXXV Addl. City Civil and Sessions Judge (CCH 36) Bengaluru, Karnataka is to be withdrawn. 4. That 3 original copies with attested affidavits of this Joint Memo of Settlement will be prepared and one copy will be filed before, this Hon'ble Court, the other two Copies shall be filed in, Bengaluru within one week in the other two cases presently pending there namely Crl.P.8309 of 2025 in the Karnataka High Court and Misc.59 of 2019 before the XXXV Addi City Civil & Sessions Judge. Since the two cases in Bengaluru were filed by the Second Party, Certified copies of the Orders will be duly obtained from the respective courts first, and produced before this Court, prior to passing any order herein in Delhi. 5. That this Hon'ble Court would adjourn the matter for a period of 4 weeks to await the relevant orders from the Concerned Courts required for the closure of this Case for compounding. 6. It is agreed amongst the parties to this settlement that Sh. G. Venkatesh Rao/ First Party shall take appropriate steps by filing an Application/Joint Application before the concerned Court for withdrawal of his Case bearing CR Case No. 10282/2016 arising out of FIR No. 21/2008 registered at PS: New Ashok Nagar and presently in the court of Ms. Prigya Gupta, CJM East District Karkardooma, within 15 days from the date of the orders passed in the 2 cases in - 5 - HC-KAR NC: 2026:KHC:28632 CRL.P No. 8309 of 2025 Bengaluru, referred in Para 3 and para A hereinabove, and after obtaining necessary certified copies of the same. 7. Thus both the parties have mutually and amicably agreed to withdraw their respective complaint/ Suit/Case filed against each other and with the withdrawal of the said complaint/suit/case both the parties shall be relieved of their respective obligations as against each other and both parties shall be a liberty to lead their life as per their choice without any intervention from one another or through their family members, agents, employees or any other interested party or representatives. 8. Both the parties agree and confirm that they (or through their agents/representatives) shall not file any complaint/ case/suit against each other in future with respect to the subject matter of the above complaint/case/suit. 9. Both the parties agree and confirm that there are no dues against each other in terms of money or otherwise against each other and even, if any, the same shall stand absolved in view of this settlement. Further both the parties confirm that there is no claim/s against each other for quashing. 10. Both the parties have mutually agreed to the above said terms and conditions in the good interest of both of them out of their own free will and volition and without any misrepresentation, coercion, undue influence, fraud etc. This compromise petition (Joint-Memo) shall become part of the above Complaint and the same shall be filed before the respective cases/court to get the appropriate relief in terms hereinbefore. 11. That in case any of the parties fail in performance of its obligations as per this settlement, the other party shall be at the liberty to have their complaint/suit restored from the concerned court. 12. The Parties undertake to be present through their respective counsels before the Hon'ble Court during the court hearing to confirm the terms of the present Settlement Agreement. 13. That the Parties undertake that they are bound by this Settlement Agreement and further undertake to abide by the - 6 - HC-KAR NC: 2026:KHC:28632 CRL.P No. 8309 of 2025 terms and conditions set out in the agreement and not to dispute the same hereinafter in future.” In the light of the afore-quoted joint memo of settlement of the parties, I deem it appropriate to terminate the proceedings against the petitioners, as the dispute and the allegations are between the individuals and not against the State. 4. For the aforesaid reasons, the following: O R D E R (a) The criminal petition is disposed. (b) The impugned crime in Crime No.523/2010, pending before the X Additional Chief Judicial Magistrate, Mayo Hall, Bengaluru City, qua the petitioners, stands quashed.
