NAGARAJU N Counsel for the Respondent(S): 1. GP FOR REVENUE 2. GP FOR IRRIGATION COMM AREA DEV RC,J W.P.No.24588 of 2025 3 ORDER This writ petition is filed questioning the endorsement of respondent no.5 through proceedings Ref.No.E/188/2022, dated 20.09.2022 rejecting the petitioners’ claim (shown at Sl.No.543 & 545 of the said proceedings) for grant of Rehabilitation and Resettlement Package on the ground that they are Married-Non-Residents. 2. Heard Sri Nagaraju N., learned counsel for the petitioners, and the learned Assistant Government Pleader for Irrigation. 3. Sri Nagaraju N., learned counsel for the petitioners, while reiterating the contents of the writ affidavit would contend that the petitioners being permanent residents of Kukunoor village & Mandal, West Godavari District, which was submerged in Polavaram National Project and their marriages having been performed in the year 01.10.2017 & 13.08.2017 i.e., after the cutoff date, they are entitled for getting the Rehabilitation and Resettlement (R&R) Package. He would further contend that though the petitioners submitted all the relevant documents to substantiate their eligibility to get R&R package, the respondent no.5, without considering the said documents, rejected the claim made by the petitioners through the impugned endorsement. He would further submit that the petitioners fulfil all the requisite conditions for getting R&R package and therefore, the impugned endorsement is liable to be set aside. RC,J W.P.No.24588 of 2025 4 In support of his contentions, the learned counsel placed reliance on the orders passed by this Court in W.P.No.11333 of 2020, dated 24.08.2021 and W.P.No.3123 of 2023, dated 06.03.2023. 4. On the other hand, learned Assistant Government Pleaders for Irrigation & Land Acquisition contended that the impugned endorsement is well considered and the same since does not suffer from any infirmity or flaw, no interference of this Court is warranted. Accordingly, prayed to dismiss the writ petition. 5. Perused the material on record and considered the submission made by the learned counsel for the parties. 6. The petitioners claim R&R package being the major members of the affected family and their marriages were performed after cutoff date. To substantiate their age and marital status, they filed their Secondary School Certificates and marriage certificates along with the writ petition. The marriage certificates show that their marriages were performed on 01.10.2017 and 13.08.2017 respectively. The impugned orders stating that the petitioners are not entitled to get R&R package, since they were married and non-residents by the cutoff date. The said order has been passed without assigning cogent reasons and basis of information for reaching such a conclusion. The decision in Writ Petition No.11333 of 2020, dated 24.08.2021 squarely applies to this case. Therefore, the impugned orders are cryptic and the same is not sustainable and accordingly, the same is liable to be set aside. RC,J W.P.No.24588 of 2025 5 7. In the result, the writ petition is allowed setting aside the impugned endorsement dated 20.09.2022 of rejection of Rehabilitation and Resettlement package to the petitioners on the ground of Married-Non- Resident and respondent no.5 is directed to pass reasoned order afresh, within a period of three (03) months from the date of receipt of a copy of this order, after affording reasonable opportunity to the petitioners. There shall be no order as to costs. Consequently, miscellaneous petitions pending, if any, shall also stand closed. ___________________________ JUSTICE RAVI CHEEMALAPATI DATE: 28TH day of January, 2026. RR
