JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioners are before this Court, seeking the following prayer: "WHEREFORE, the Petitioners most respectfully prays that, this Hon'ble Court may be pleased to quash the FIR in CR No 30/2026 of KGF CEN Crime police station for the offence's Punishable punishable under Section 66(D) of the Information Technology Act, 2000 and Section 318(4) of the Bharatiya Nyaya Sanhita, 2023 (BNS), pending before the ADDL CIVIL JUDGE (JR DN) & JMFC COURT KKOLAR DIST KGF in the interest of justice and equity." 2. Heard Sri. Afroz Pasha, learned counsel appearing for the petitioners, Smt. Rashmi Patel, learned HCGP appearing for respondent No.1, Sri. Rajesh S.R., learned counsel appearing for respondent No.2 and have perused the material on record. 3. During the pendency of the proceedings, the parties to the lis have settled the dispute among themselves and have filed a compounding application along with the joint affidavit. The joint affidavit so filed reads as follows: - 4 - HC-KAR NC: 2026:KHC:30909 CRL.P No. 8217 of 2026 “JOINT AFFIDAVIT” We I Madan M , S/o Muniraj, aged about 26 years Residing at Makanahalli Village, Anugondanahalli Hobli Hosakote Taluk Bangalore District Karnataka - 560114, today at Bangalore City AND SUNIL KUMAR T, S/o Late Thangasaru, aged about 33 years, R/at No.150, Sumathi Nagara, 2nd Cross, Robertsonpet, KGF-563122. do hereby solemnly affirm and state on oath as follow. 1. I Madan N, accused/petitioner no1 in the above case and I am fully conversant with the facts of the case and I am swearing to this affidavit on behalf of accused petitioner no 1, 2 and 3 also. 2. I SUNIL KUMAR T I am the complainant in the above case and I am fully conversant with the facts of the case and I am swearing to this affidavit. 3. We submit that, we have filed an application u/s 359 (2) OF BNSS to compound the offences in the above criminal petition. 4. That, the disputes between us have been resolved and we have decided to settle the matter between them. 5. I SUNIL KUMAR T, I have received entire amount of invested with the Petitioner company and further I don’t have any other claims against the Petitioners and their company. 9. I Sunil Kumar T confirms that I have received sum of Rs 3,07,700 by way of demand draft bearing Demand Draft No.343384 dated 10.06.2026 drawn on Karnataka Bank Limited in my name and also received sum of Rs 24300 via UPI and I don’t have any other claims against the Petitioners and their company. 10. We submit that, the above offences are compundable with the permission of this Hon'ble Court and That, this Hon'ble court have jurisdiction u/s 528 of BNSS to quash the entire FIR basis settlement between the parties. 11. We submit that, we have settled our disputes with own will and wish without any influence or force. - 5 - HC-KAR NC: 2026:KHC:30909 CRL.P No. 8217 of 2026 What is stated above is true and correct to the best of my knowledge, information and belief. wherefore it is most respectfully prayed that this Hon'ble may please to: A. Allow application filed u/s 359 (2) OF BNSS, and permit the parties compound the offences. B. Pleased to entire quash the entire quash the FIR in CR No 30/2026 of KGF CEN Crime police station for the offence's Punishable punishable under Section 66(D) of the Information Technology Act, 2000 and Section 318(4) of the Bharatiya Nyaya Sanhita, 2023 (BNS), pending before the ADDL CIVIL JUDGE (JR DN) & JMFC COURT KOLAR DIST KGF in the interest of justice and equity." 4. The parties to the lis are present before the Court and are identified by their respective counsel. 5. In the light of application for compounding being filed along with the joint affidavit and offences not being against the State, I deem it appropriate to accept the compounding application and terminate the proceedings against the petitioners in the subject petition. 6. For the aforesaid reasons, the following: ORDER (i) Criminal Petition is disposed. - 6 - HC-KAR NC: 2026:KHC:30909 CRL.P No. 8217 of 2026 (ii) Proceedings pending in Crime No.30/2026, stands quashed qua the petitioners.
