2/24.08.2026 Heard learned counsels for petitioner and for State.
2. The petitioners are apprehending their arrest in connection with Complaint Case No.1405 of 2024, for offence registered under section 33(1)(c) of Indian Forest Act, pending in court of learned Judicial Magistrate First Class, Chatra.

Learned counsel for petitioners submits that the petitioners have been falsely implicated in this case and the allegations are made of cultivation of poppy plants in the forest land. He also submits that the said land is not belonging to the petitioners and

the petitioners are villagers having no criminal antecedent as disclosed in paragraph no.11 of the petition.
4. Learned State counsel opposes the prayer and submits that allegations are there of cultivation of poppy plants in the forest land.
5. Considering that the land is belonging to the forest department and the same is not belonging to the petitioners and further the petitioners are said to be villagers having no criminal antecedent as aforesaid, I am inclined to grant anticipatory bail to petitioners.

Accordingly, petitioners, above named, are hereby directed to surrender before learned court within three weeks from today, and in event of their surrender/arrest, petitioners, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each, with two sureties of like amount each, to satisfaction of learned Judicial Magistrate First Class, Chatra, in connection with Complaint Case No.1405 of 2024, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
