Heard the parties.
The petitioners have been made accused in connection with S.T. Case No.76 of 2026 arising out of Jaldega P.S. Case No.16 of 2026 registered for the offences punishable under Sections 103(1), 238 & 3(5) of the BNS,
2023.
Learned counsel for the petitioners submits that the allegation against the petitioners is that the petitioners have committed murder of Shiva Sahu and caused destruction of the evidence of the murder by setting the dead body on fire by pouring petrol over the same. It is next submitted that the allegations against the petitioners are all false and the petitioners are not named in the FIR. It is then submitted that except the confessional statement of the co-accused, there is no material in the record to implicate the petitioners in this case. It is also submitted that charge sheet has been submitted in this case. It is then submitted that the petitioners have no criminal antecedent as has been mentioned in para-15 of this bail
application. It is lastly submitted that the petitioners have been in custody since 28.03.2026 as has been mentioned in para-16 of this bail application. It is next submitted by
learned counsel for the petitioners that the petitioners are ready and willing to co-operate with the trial of the case and undertakes not to annoy or disturb the informant or the other witness of the case in any manner during trial of the case. It is next submitted that the co-accused with similar allegations has already been admitted to bail by this court vide order dated 17.08.2026 passed in B.A. No. 7678 of 2026 hence, the petitioners may be admitted to bail. Learned Addl. P.P. opposed the prayer for bail. Considering submissions of learned counsels and the facts as stated above, I am inclined to release the petitioners on bail. Hence, the court below is directed to release the petitioners on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Simdega in connection with S.T. Case No.76 of 2026 arising out of Jaldega P.S. Case No.16 of 2026 with the condition that the petitioners will not annoy or disturb the informant or the other witness of the case in any manner during trial of the case and will co- operate with the trial of the case and will furnish mobile phone number and photocopy of the Aadhar Card in the court below with an undertaking that they will not change the mobile phone number during the trial of the case.
