GP FOR HOME The Court made the following: ORDER: The Writ Petition has been filed for the following relief: “…to issue a Writ, order or direction more particularly one in nature of Writ of Mandamus, declaring the action on the part of Officials of Respondent No.3 in interfering with civil dispute there by demanding Petitioner to hand over Rs.3, 00, 000-00 to 4th Respondent herein alleging that same are due from Petitioner to 4th Respondent as illegal, arbitrary, unconstitutional, voilative of rights of citizens envisaged under the articles of Constitution of India and consequently direct the Officials of Respondent No.3 to not to call the Petitioner to Police Station for resolving any civil dispute with respect to financial issues with 4th Respondent …” 2. Heard the learned counsel for Petitioners and learned Assistant Government Pleader. 3. Mr. N. Chandra Sekhar Reddy, learned counsel for the Petitioner, submits that at the behest of Respondent No.4, the Petitioner was called to the Police Station by Respondent No.3 and unnecessarily subjected to harassment. 4. Sri P. Ajay Babu, learned Assistant Government Pleader, on written instructions, submits that Respondent No.4 lodged a complaint through PGRS, and based on the same, a preliminary enquiry was conducted by calling both the Petitioner and Respondent No.4 to the Police Station. It was found that the complaint of Respondent No.4 was civil in nature, and therefore, the police advised both parties to work out their remedies before the competent civil court. 3 5. Having regard to the facts and circumstances of the case, and the submissions of the learned Assistant Government Pleader, the Writ Petition is disposed of directing the Respondent No.3 not to interfere henceforth in the civil dispute between the Petitioner and Respondent No.4 without following due process of law. 7. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs. As a sequel, Miscellaneous petitions, if any pending, shall stand closed. _________________________ DR. Y.
