Petitioner has filed this writ petition seeking following reliefs:- ‘10.1That, the Hon’ble Court may kindly be pleased to direct the respondents to pay the regular pay scale 2 from the date of completion of 03 years (i.e. 05.01.1994) which the other similarly situated employees have been posted in regular pay scale; 10.3 That, this Hon’ble Court may kindly be pleased to direct the respondents to fix the seniority and the salary of the petitioner accordingly and pay the arrears of the difference of the salary; 10.3 Any other relief,which this Hon’ble Court may deem fit and proper may also be passed in favour of the petitioner together with the cost of the petitioner.” 2. Learned Counsel for the petitioners submits that petitioners were appointed on the post of Waterman under the respondent No.1 department on 05.01.1991 respectively as daily wage employee on Collector rate. They are entitled to get benefit of regular pay scale after completion of three years of service. However, he has been granted regular pay-scale from 08.09.2008. He further submits that similar relief has already been granted to certain persons and their services were also regularized. He refers to an order dated 20.04.2018 and submits that in the like situation, few of other persons, similarly placed, have been given benefit of regular pay scale on completion of three years of service. 3. At this juncture, learned State Counsel submits that it would be better if petitioners file a detailed fresh representation before Respondent No.4 along with all relevant documents in support of their claim including the orders of the State Government as also the orders of the High Court in 3 other identical case. He further submits that in case representation is made, Respondent No.4 will decide the same at the earliest. 4. Considering facts of the case, submissions of learned counsel for the respective parties, writ petition is disposed of at this stage granting liberty to the petitioner to file a fresh representation before respondent No.4 along with all relevant documents. On making such representation, respondent No.4 shall consider and decide the same, in accordance with law within a period of ‘90 days’ from the date of receipt of copy of such representation. 5. However, it is made clear that this Court has not expressed any opinion merit of the case of petitioner. The respondents-authorities shall be free to take decision on its own merit in accordance with law. 6. With the aforesaid observation and direction, this writ petition stands disposed of.
