KAMAL ORAL ORDER The petitioner claims to be an allottee of an industrial plot measuring North to South 30 metres, East to West 12.60 metres, totally measuring 378 metres, bounded on North by road, South by private property, East by Nala(Halla), West by Septic Tank. 2. Learned counsel for the petitioner submits after allotment of the said plot, the Nala/kaluve which was existing on its Eastern side has been shifted, which has resulted in availability of additional space of about 200 square metres. The petitioner has sought for allotment of the said additional space of 200 metres situated between Nala on the Eastern side and the plot of the petitioner on the Western side. 3. Learned counsel for the petitioner further submits that the petitioner has already gone to the Civil Court and has obtained an order of injunction restraining the authorities from allotting it to the third party. Therefore, he has a right for - 4 - HC-KAR NC: 2026:KHC:31593 WP No. 10032 of 2022 allotment of the said plot in favour. This Court is not persuaded to grant a relief of mandamus as sought for as neither any legal rights of the petitioner for grant of said additional land nor breach of such rights are pointed out. 3. Accordingly, the petition is disposed of. Petitioner is at liberty to make an application in the normal course and if he is entitled and fulfils the applicable criteria of allotment, the respondent authorities shall consider the same in accordance with law.
