In this petition, petitioner is assailing the order/endorsement dated 11.04.2022 (Annexure-C) passed by respondent No. 2, inter alia, sought for a direction to respondent No.2 to regularize the land in question which is in the occupation of the petitioner and to issue Saguvali Chit. 3. It is argued by learned counsel for the petitioner by referring to Annexure-G dated 27.11.2017 and submitted that, the jurisdictional Tahsildar has - 3 - HC-KAR NC: 2026:KHC:31803 WP No. 15613 of 2022 accepted the application, has confirmed the right over the land in question to the petitioner, however, the impugned order at Annexure-C, the very same officer has issued impugned Endorsement dated 11.04.2022 stating that the land in question comes within the purview of the forest zone and accordingly sought for interference by this Court. 4. Per contra, Smt. B P Radha, learned AGA places the letter dated 02.09.2022 addressed by the Range Forest Officer, Shanthisagara Range, Mavinakatte, to the Tahsildar, Bhadravathi Taluku, wherein as per the Notification dated 09.09.1936, the land bearing Sy.No.50 of Thadasa Village was declared as the reserve forest. 5. In that view of the matter, following the declaration law made by the Hon'ble Supreme Court in the cases of STATE OF KARNATAKA AND OTHERS v. I.S. NIRVANE GOWDA AND OTHERS reported in (2007) 15 SCC 744 and T.N. GODAVARMAN THIRUMULPAD v. UNION OF INDIA reported in (2025) 2 SCC 641, I am - 4 - HC-KAR NC: 2026:KHC:31803 WP No. 15613 of 2022 of the view that, no interference is called for in this writ petition and the same stands dismissed.
