ORAL ORDER
1. Accused no.2 in Crime No.24/2026 registered by Amruthahally Police Station, Bengaluru City, for the offences punishable under Sections 20(b), 8(c) & 22 of NDPS Act, 1985, is before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail.
2. Heard the learned Counsel for the parties.

FIR in Crime No.24/2026 was registered by Amruthahally Police Station, Bengaluru City, for the aforesaid offences against one Kushal and three others based on the first information dated 19.01.2026 received from Ramesh, Police Officer attached to Amruthahally Police Station. During the course of investigation, petitioner herein who is arrayed as accused no.2 in the FIR was arrested and remanded to judicial custody on 19.01.2026. His bail application filed before the jurisdictional Sessions Court in Crl. Misc. No.1709/2026 was rejected on 04.03.2026. Therefore, petitioner is before this Court.

Learned Counsel for the petitioner submits that the contraband article seized in the present case is of intermediate quantity. Considering the same, accused no.4 was granted regular bail by the coordinate bench of this Court in Crl.P.No.4921/2026 disposed of on 29.04.2026. Thereafter, accused nos.10 & 12 have been granted regular bail in the present case. He submits that accused nos.5 to 7 have been granted regular bail by this Court in Crl.P.No.4683/2026. Petitioner is a student pursuing his second year law degree in Presidency University, Bengaluru. He has no criminal antecedents. Accordingly, he prays to allow the petition. 5. Per contra, learned HCGP who has opposed the petition, does not dispute the submissions made by the learned Counsel for the petitioner. He, however, submits that investigation of the case is under progress. Accordingly, he prays to dismiss the petition. 6. Perusal of the material on record would go to show that FIR in Crime No.24/2026 was registered against one Kushal and others based on the credible information received. The contraband article seized in the present case is jointly from

accused nos.1 to 4 named in the FIR. Petitioner is arrayed as accused no.2 in the FIR. Wilson is arrayed as accused no.4 in the FIR. The coordinate bench of this Court in Crl.P.No.4921/2026 disposed of on 29.04.2026, has granted regular bail to accused no.4 - Wilson. The allegation as against the petitioner and accused no.4 is similar. Undisputedly, petitioner has no other criminal antecedents. The material made available to this Court would go to show that petitioner is a student pursuing his second year law degree in Presidency University, Bengaluru. He is aged about 22 years and his continued detention amongst hard core criminals is likely to have an adverse impact on his future prospects. Accused nos.5 to 7 and 10 to 12 also have been granted regular bail in the present case. Under the circumstances, I am of the opinion that the prayer made by the petitioner is required to be answered affirmatively. Accordingly, the following order:
7. The petition is allowed.
The petitioner is directed to be enlarged on bail in Crime No.24/2026 registered by Amruthahally Police Station, Bengaluru City, for the offences

punishable under Sections 20(b), 8(c) & 22 of NDPS Act, 1985, subject to the following conditions: a) Petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court;
b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons;
c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses;
d) The petitioner shall not involve in similar offences in future;
e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off. Sd/- (S VISHWAJITH SHETTY) JUDGE
