This petition has been filed under Section 29-A of the Arbitration and Conciliation Act, 1996 (for short, “the Act”), seeking extension of the mandate of the Arbitral Tribunal. This Court, vide order dated 20.12.2024, appointed Engineer Mr. Vinod Sharma, C/o 42, Sector 1-A, Trikuta Nagar, Jammu, as the Sole Arbitrator to adjudicate upon the disputes between the parties and render an award in accordance with law. 2. It is averred that the arbitral proceedings involve scrutiny and examination of voluminous records, inter alia, running account bills, final bills, engineering drawings, measurement books, departmental correspondence, contractual specifications, variation orders and inter-departmental communications, requiring detailed and methodical consideration. Owing to the nature and volume of the record involved, the arbitral proceedings could not be concluded within the period prescribed under Section 29-A of the Act. The petitioner has, accordingly, approached this Court seeking extension of the mandate of the learned Sole Arbitrator. Sr. No. 188 2 Arb P No. 81/2026 3. Learned counsel appearing for the respondents submits that he has instructions not to oppose the prayer and, accordingly, accords consent to the extension of the mandate of the learned Sole Arbitrator. 4. Having regard to the averments made in the petition, the nature of the disputes involved and the submissions made by learned counsel for the parties, this Court is satisfied that sufficient cause exists for extension of time for completion of the arbitral proceedings. 5. Accordingly, in exercise of the powers conferred under Section 29-A of the Act, the mandate of the learned Sole Arbitrator is extended for a further period of three months from today, within which period the Arbitrator shall endeavour to conclude the arbitral proceedings and render the award in accordance with law. A copy of this order be communicated to the learned Sole Arbitrator forthwith for information and compliance 6. The petition stands disposed of in the above terms.
