Instant petition has been filed under Section 482 BNSS by the petitioner seeking pre-arrest bail in connection with Lalbag P.S. No. 109 of 2020 corresponding to G.R. Case No.549 of 2020 pending in the file of learned S.D.J.M.(S), Cuttack on the grounds stated. 3. Perused the FIR as at Annexure-1. The petitioner is a builder and said to have sold a flat to the informant. The allegation in the FIR is regarding a promise to provide a car parking area and for that, the petitioner said to have received an amount of Rs.2.5 lac. It is alleged therein that no such provision was made for the informant, hence, he has been cheated by the petitioner. Considering the nature of dispute and it was in connection with a complaint by the informant for having paid the alleged amount with an assurance of being provided space for car parking, this Court, with the objection of the State being p. 2 noted down, is inclined to direct the petitioner to surrender before the learned court below for being released with conditions even though his bail plea is not entertained. 4. Accordingly, it is ordered. 5. In the result, the ABLAPL is disposed of with the direction as aforesaid. It is further directed that in the event, the petitioner surrenders before the court of learned S.D.J.M.(S), Cuttack in connection with G.R. Case No.549 of 2020 corresponding to Lalbag P.S. No. 109 of 2020 within a fortnight from today, he shall be released on bail upon furnishing a bail bond of Rs.30,000/-(rupees thirty thousand) with one solvent surety for the like amount with such other conditions imposed as deemed just and proper in the facts and circumstances of the case. 6.
