02/27.08.2026 Heard learned counsel for the petitioner and learned counsel for the State.
2. The petitioner is apprehending his arrest in connection with Rajrappa P.S. Case No.78 of 2026, registered for the offence under Sections 115(2), 126(2), 118(2), 109(1), 303(2), 317(5), 352, 351(2) and 3(5) of Bhartiya Nyaya Sanhita, 2023, pending in the court of learned Sub Divisional Judicial Magistrate, Ramgarh.

Learned counsel appearing for the petitioner submits that false allegation is made of trying to steal the diesel from the godown of the CCL and the allegations are made of scuffle with the security personnel. He submits that even the allegations are made of assault by sword, however, the injury is found to be simple and that has come in the order of the learned Sessions Judge. He next submits that that allegation is there against 18 to 20 persons.

Learned counsel appearing for the State opposes the prayer and submits that the allegations are there of forcefully entering and trying to steal the diesel from the godown of the CCL. On these grounds, he submits that prayer for anticipatory bail may kindly be rejected.

On perusal of the FIR, it transpires that the allegations are there of attempt to steal the diesel and the allegation is there against 18 to 20 persons and in the order of the learned Sessions Judge, it has come that the injury is found be simple wherein the allegation is made of assault even by sword, in the attending facts and circumstances, I am inclined to grant anticipatory bail to the petitioner.

Accordingly, the above-named petitioner is directed to surrender before the learned court within three weeks from today and in the event of his arrest or surrender, he shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Ramgarh, in connection with Rajrappa P.S. Case No.78 of 2026, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
