Learned counsel appearing for the petitioner seeks permission to withdraw the present petition and prays that three months' time be granted to the petitioner to vacate the premises in question. However, in the interest of justice, the petitioner is granted time up to 31st October, 2026 to vacate and hand over vacant and peaceful possession of the premises in question to the respondent, subject to the condition that the petitioner shall file an affidavit of undertaking before the Rent Control Authority, Raipur (C.G.), within ten days from today, undertaking to hand over vacant and peaceful possession of the premises and to pay the entire arrears of rent to the respondent on or before 31st October, 2026. It is made clear that, in the event the petitioner fails to comply with any of the aforesaid conditions within the stipulated period, this order shall stand automatically dissolved without any further reference to this Court, and the respondent shall be at liberty to execute the order in accordance with law.
