The instant writ petitions have been preferred by the petitioners against oral termination of their services by respondent authorities. 2. Learned counsel appearing for the petitioners submits that in the year 2019, the respondent department orally removed the petitioners from the post of Data Entry Operator without affording opportunity of hearing. He further submits that petitioners 3 approached the department seeking re-instatement and payment of salary but no heed was paid therefore petitioners moved respective applications before the respondent No. 6 but till date same have not been decided. He prays for a direction to the respondent No. 6 to decide the pending applications at the earliest. 3. On the other hand, learned counsel appearing for the State would oppose the submissions advanced by the counsel for the petitioners and submits that the dispute raised by the petitioners in the present case requires adjudication by the competent Labour Court. It is argued that the present petitions, in present form, are not maintainable. 4. I have heard learned counsel appearing for the parties. 5. The services of petitioners, who were working on the post of Data Entry Operator on daily wage basis were discontinued by the respondent department in the year 2019. Petitioners approached the Labour Officer, Rajnandgaon in year 2022 by filing respective applications. 6. As there is a dispute between the employer and employees, the appropriate remedy available to the petitioners is to raise industrial dispute before the competent Labour Court. Disputed questions of facts cannot be decided in a writ petition. The petitioners herein sought relief of reinstatement in service, which involves adjudication of disputed questions of fact; thus, the 4 petitions in present form are not maintainable and are hereby dismissed. 7. However, the petitioners would be at liberty to avail remedy available under the law, if so advised.
