Heard Mr.Sandeep Jha and Ms.Gunjan Tiwari, learned counsel for the petitioners as well as Mr.Shailendra Sharma, learned Panel Lawyer appearing for respondent No.1/State. 2. By way of this petition under Section 528 BNSS the petitioners have prayed for following relief:- “It is therefore, prayed that this Hon’ble Court may kindly be pleased to allow the instant petition and quash/set- aside the impugned FIR No.21/2023 registered on dated 20.03.2023 at P.S. Mahila Thana, Bilaspur (C.G.) for the offence u/s 498(A) & 34 of the I.P.C., the cognizance order passed by learned J.M.F.C. Bilaspur (C.G.) on dated 24.04.2023, the entire criminal proceeding (in criminal case no.3100/2023) initiated against the petitioners pursuant to FIR No.21/2023 and entire charge- sheet, in the interest of justice.” 3. Learned counsel for the petitioners submits that, in view of the compromise arrived at between the husband (petitioner Kisan Sahu in CRMP No. 77/2026) and respondent No. 2, this Court has already quashed FIR No. 21/2023 registered on 20.03.2023 at Police Station Mahila Thana, Bilaspur, as well as the cognizance order passed by the learned Judicial Magistrate First Class, Bilaspur on 24.04.2023, and the charge-sheet filed pursuant to the said FIR on 13.01.2025, insofar as it relates to Kishan Sahu, husband of respondent No. 2. It is further submitted that, considering the fact that Kishan Sahu and respondent No. 2 have amicably settled their disputes, the 3 proceedings against the present petitioners may also be quashed. 4. Learned Panel Lawyer appearing for respondent No. 1 does not dispute the said fact. 5. Considering that Kishan Sahu (husband) and respondent No. 2 have already settled their disputes amicably, and that this Court has already quashed the criminal proceedings pending before the Judicial Magistrate First Class, Bilaspur in Criminal Case No. 3100/2023 with respect to Kishan Sahu, subject to fulfillment of the terms and conditions of the compromise entered into between the parties on 26.07.2025, it would be in the interest of justice to also quash the criminal proceedings pending before the Judicial Magistrate First Class, Raipur in Criminal Case No. 3100/2023 with respect to the present petitioners. 6. In view of above, the petition is allowed, and criminal proceedings pending before the Judicial Magistrate First Class, Bilaspur in Criminal Case No. 3100/2023, arising out of FIR No. 21/2023 registered on 20.03.2023 at Police Station Mahila Thana, Bilaspur for offence under Section 498A/34 of the IPC, along with the order taking cognizance dated 24.04.2023 and all consequential proceedings against the present petitioners, are hereby quashed.
