1. This first transit/anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No.231/2025 registered at Police Station – East CEN Crime PS District- Bengluru City (Karnataka), for the offence punishable under KRISHNA KUMAR BARVE Digitally signed by KRISHNA KUMAR BARVE Date: 2026.07.02 18:28:04 +0530

2. Case of the prosecution is that on 1.7.2025, complainant Nirmala saw an advertisement on facebook about trading stock market and link was also mentioned. When she clicked on the link, she was directly joined to an Whatsapp group namely, “Varanium ILY-B169. There was
discussion about trading in the group and they contacted separately through Whatsapp number 9932495853. The complainant was told that if she invest in stocks and regular trade, she would get huge profit. The complainant accepted the same. Thereafter the application was shared with the complainant which was to be downloaded from the play store by name “Varaniumpro” and the complainant was asked to fill online application for registration purpose. The complainant was supposed to first deposit the funds in the account of third party provided by the customer service through chats in the application. Thereafter she was supposed to buy the stocks suggested by them on the application and sell the same on the next day. On 3.6.2025, the complainant firstly deposited Rs.10,000/- and thereafter deposited Rs.1,00,000/- and on several occasions the complainant deposited some amount. When the complainant was asked to pay the commission of 10% of profit to withdraw amount, she became suspicious and ultimately, the complainant lodged the FIR. 3. Learned Senior counsel for the applicant submits that the applicant is innocent and has been falsely implicated in the offence in question. It is further submitted that two cases were registered against the applicant in Bengaluru city and in one case, the applicant has already been granted transit/anticipatory bail vide order dated 4.12.2025 passed in
3 MCRCA No.1909/2025 and thereafter in the said case, the applicant has been granted regular bail by the competent Court on 17.12.2025 vide Annexure-A/17. As such, the present transit/anticipatory bail application may be allowed. 4. On the other hand, learned State counsel opposed the prayer for grant of transit/anticipatory bail. 5. I have heard learned counsel for the parties and perused the material available on record. 6. Considering the facts and circumstances of the case, nature and gravity of allegation made against the applicant and the fact that the applicant is a Government employee serving as a Lecturer (Physics) at Government Higher Secondary School, Pakhnakot, Block Dharamjaigarh, District Raigarh (C.G.), and further considering the fact that one of the co-accused, namely Anusuiya Sandilya, Director of Jeevandayini Sathi Foundation, who was arrested in the same case, has been granted bail by the Learned Chief Judicial Magistrate, Bengaluru, vide order dated 31.10.2025, this Court deems it appropriate to grant transit/anticipatory bail to the present applicant. 7. Accordingly, the instant transit/anticipatory bail is allowed for a temporary period of two weeks.
It is directed that in the event of arrest of applicant in connection with the aforesaid offence, he shall be released on bail by the Officer arresting him on his executing a personal bond with one surety in the like sum to the satisfaction of the concerned Investigating Officer. Thereafter, he is at liberty to take recourse to law before the Court of competent jurisdiction. 4
