2
THE HONOURABLE SMT JUSTICE V.SUJATHA CONTEMPT CASE NO: 4110/2024 O R D E R:
1. This Contempt Case is filed for willful violation of the orders passed by this Court in W.P.No.26686 of 2016 on 20.07.2023, wherein this Court passed the following order:
“In view of the fact that the respondents under similar circumstances have considered the case of Mr. M.Subrahmanyam E506406 and Sri Radhakrishna E502323 for promotion to the post of Junior Assistant (P), instead of keeping this writ petition pending, this court feels it appropriate to dispose of this writ petition by directing the petitioners to make a fresh representation to the 2nd and 3rd respondents in this regard within a period of two (2) weeks from the date of receipt of a copy of this order and on filing such representation, the respondents are directed to dispose of the same within a period of four (4) weeks thereafter."
2. Today when the matter is taken up for hearing, Sri P.Govinda Rajulu,
learned Counsel for the Petitioners submitted that in pursuance of the orders passed by this Court on 20.07.2023 the petitioners have submitted fresh representations on 03.08.2023. Thereafter, 2nd respondent has passed orders dated 08.12.2023 in compliance to the Orders passed by this Court in W.P.No.26686 of 2016 dated 20.07.2023.
3. On perusal of the proceedings dated 08.12.2023 of the Executive Director, Zone-3, Nellore, which are issued in pursuance of the representations of the petitioners dated 03.08.2023, which in fact were submitted in pursuance of the
3
order dated 20.07.2023 passed by this Court in W.P.No.26686 of 2016, it can be observed that the selection committee vide proceedings dated 18.07.2016 has noted that the petitioner No.1 has not submitted willing for JA (P) and hence he was not selected, with regard to petitioner No.2, it was stated that as he has submitted willing for JA (P), he was selected as JA (P). However, the committee rejected their case appointment/promotion as JA (F) on the ground that the Corporation has invested substantially in their training as JA (P) and they have also worked in PD as JA for quite some time. Subsequently, in the selections held on 21.09.2017, similar view was taken by the Selection Committee. However, the rejection orders further disclosed that as far as the selections are concerned, the Selection Committee has taken a decision in the best interest of the organization, and hence, there is no reason for the Executive Engineer to intervene in the matter and overturn the decision of the Selection Committee and appoint the petitioners as JA (F).
4. As the respondents have already rejected the fresh representation submitted by the petitioners on merits vide proceedings dated 08.12.2023, which in fact is in compliance to the orders dated 20.07.2023 passed by this Court in W.P.No.26686 of 2016, this Court is of the opinion that no contempt case is made out by the petitioners.

5. Accordingly, the contempt case is closed. However, liberty is given to the petitioners to challenge the proceedings dated 08.12.2023 issued by the Executive Director, Zone -3, Nellore. No costs.
As a sequel, miscellaneous applications, pending, if any, shall also stand closed.
