The petitioner in this writ petition has prayed to remove the encroachment from an alleged Water Canal situated on government land being identified as daag no.422 which is connected to the pond of the petitioner being identified as daag no.433 falling under mauza Kanchanpur, thana No.353 under Dist- Godda. 3. It is the grievance of the petitioner that respondent No.8 has encroached the said canal and has filled it up for making PCC road. 4. Learned counsel for petitioner submits that the construction of the PCC road now has been stopped and the encroachment of the Canal has to be removed. 5. Considering the submission of the parties, if the there is a canal recorded in the survey records, the same should be made encroachment free. If there is any encroachment over a Canal as 2026:JHHC:25789 Page | 2 recorded in the survey records, over the land in question, I direct the respondents to remove the same within a month. 6.
