Accused Nos.4 and 5 are before this Court in this petition filed under Section 482 of Cr.P.C, with a prayer to quash the entire proceedings in C.C.No.51695 of 2019 pending before the Court of XXIX Addl. Chief Metropolitan Magistrate at - 3 - HC-KAR NC: 2026:KHC:32279 CRL.P No. 8571 of 2022 Bengaluru, arising out of Crime No.11 of 2018 registered by Vivek Nagar Police Station, Bengaluru for offences punishable under Sections 143,448, 498(A), 341, 323, 504, 506 & 149 of IPC. 2. Heard the learned counsel for the parties. 3. Learned advocates appearing on behalf of the contesting private parties submit that the dispute between the husband and wife has been amicably settled and the impugned proceedings so far as it relates to accused nos.1 to 3 has been already quashed by the Co-ordinate Bench of this Court in Criminal Petition No.8383 of 2026 disposed of on 24.06.2026. They submit that petitioners herein are relatives of accused no.1 and they have filed a joint application supported by joint affidavit under Section 320 of Cr.P.C, with a prayer to permit the parties to compound the offences for which charge sheet has been filed in the present case. 4. The parties who are before this Court are identified by their respective advocates. The application seeking permission of this Court to compound the offences, for which - 4 - HC-KAR NC: 2026:KHC:32279 CRL.P No. 8571 of 2022 charge sheet has been filed in the present case is taken on record. In paragraph nos.4 to 7 of the application which is signed by the parties and also by their learned advocates, it is stated as follows: "4. It is submitted that during the pendency of the above Criminal Petition, at the intervention of elders, well-wishers, family members and responsible persons, the parties have amicably settled all their disputes. Respondent No.2 Susainathan does not intend to proceed further with the criminal case against the Petitioners. 5. It is submitted that the compromise arrived at between the Petitioners and Respondent No.2 Susainathan is voluntary, lawful and genuine. The same has been entered into without any force, threat, coercion, undue influence, pressure or misrepresentation from any person whomsoever. 6. Respondent No.2 Susainathan submits that he has no objection for this Hon'ble Court to record the compromise and to quash the entire proceedings in C.C. No.51695/2019 pending on the file of the Hon'ble XXIX Additional Chief Metropolitan Magistrate at Mayo Hall, Bengaluru, arising out of Crime No.11/2018 of Viveknagar Police Station, Bengaluru, insofar as the Petitioners are concerned. 7. It is submitted that the parties have resolved their personal, matrimonial and family disputes and there is no surviving grievance between the Petitioners and Respondent No.2. In view of the settlement, continuation - 5 - HC-KAR NC: 2026:KHC:32279 CRL.P No. 8571 of 2022 of the criminal proceedings would not serve any useful purpose and would amount to abuse of the process of law". 5. The Hon'ble Supreme Court in the case of RAMGOPAL AND ANOTHER VS. STATE OF MADHYA PRADESH reported in AIR 2022 (14) SCC 531 has held that notwithstanding the limitations provided under Section 320 of Cr.P.C, the High Courts in exercise of their powers under Section 482 of Cr.P.C, can quash criminal cases registered for non-compoundable offences depending upon the nature of the case, relationship between the parties and also the gravity of the alleged offences. 6. Under the circumstances, I am of the opinion that the prayer made by the parties in this petition to permit them to put an end to the dispute needs to be granted. 7. Accordingly, the following:- ORDER (i) criminal petition is allowed. (ii) The entire proceedings in C.C.No.51695 of 2019 pending before the Court of XXIX Addl. - 6 - HC-KAR NC: 2026:KHC:32279 CRL.P No. 8571 of 2022 Chief Metropolitan Magistrate at Bengaluru, arising out of Crime No.11 of 2018 registered by Vivek Nagar Police Station, Bengaluru for offences punishable under Sections 143,448, 498(A), 341, 323, 504, 506 & 149 of IPC is quashed as against the petitioners herein.
