) The appellants-State seek review of the order dated 10.10.2025, passed by this Court in Review Petition No. 93 of 2025 alongwith CMP.M No. 1184 of 2025, titled State of Himachal Pradesh and another Vs. Priyanka Nagu.
2. It is to be noticed that the earlier order was also passed in a Review Petition, which was directed against the
order dated 16.12.2024, passed by the Coordinate Bench of 1Whether reporters of the local papers may be allowed to see the judgment?
2 2026:HHC:40631 this court and for the reasons given, the said Review Petition was dismissed as withdrawn.
3. Apparently, the State had filed a Special Leave Petition (Civil) No. 12056 of 2026, not only against the initial
order passed on 16.12.2024, but also against the order passed by us on 10.10.2025 in Review Petition No. 93 of 2025 alongwith CMP No. 1184 of 2025. The order passed by the Apex Court, reads as under:-
“Delay condoned. The special leave petition(s) are dismissed leaving the questions of law open. Pending application(s), if any, shall stand
disposed of.”
4. Keeping in view the above, once the matter has been finally decided by the Apex Court, we do not find any plausible reason as such, as to why the second Review Petition should be entertained.
5. The argument that the question of law was left open only reserves the right of the State to raise the said issue in other separate and independent proceedings. As the litigation has become final now in favour of the respondent, therefore, there is no occasion as such, to entertain the
3 2026:HHC:40631 second Review Petition and the same also is time barred by 209 days.
6. Accordingly, the application for condonation of delay is dismissed. Resultantly, the Review Petition would meet the same fate. Pending miscellaneous application(s), if any, also stand disposed of accordingly.
