I have heard learned counsel for the appellant and learned counsel for the respondent. 2. Having perused the material on record, it is seen that this transaction has taken place between the complainant and accused in respect of a sale transaction for purchase of property. On the assurance that accused would execute the sale deed within one month, the complainant has given advance amount of Rs.10,50,000/- and when the accused did not come forward to execute the sale deed, the complainant demanded to repay the same and the petitioner did not repay the same and issued a Cheque. Subsequently, when the Cheque was dishonoured, proceedings was initiated. The accused did not plead guilty. Hence, the complainant examined - 3 - HC-KAR NC: 2026:KHC:31036 CRL.RP No. 1505 of 2024 himself as P.W.1 and got marked the documents as Exs.P1 to P8. The statement of accused was recorded under 313 of Cr.P.C. and he did not lead any defence evidence and even, he did not cross-examine the witness P.W.1. 3. Having taken note of the same, question of entertaining the revision petition does not arise. The Trial Court also in detail discussed with regard to the case of complainant in paragraph Nos.11 and 12 of the judgment. Hence, I do not find any ground to entertain this revision petition and no ground is made out to admit the revision. Accordingly, the revision petition is dismissed.
