The applicant has preferred this First Bail Application under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Crime No.34/2024, registered at Police Station: Konta, District- Sukma, Chhattisgarh for the offences punishable under Section 20(B)(ii)(B) of the Narcotic Drugs and Psychotropic Substances Act, 1985, for short, the NDPS Act. 2. As per the prosecution story in brief, a perusal of the charge sheet reveals that the accused/applicant, Chutturi Ashok, son of Chutturi Venkatrao, was arrested on 09.11.2024 in connection with Crime No. 34/2024 registered at Police Station Konta, District Sukma, for the offence PREETI KUMARI Digitally signed by PREETI KUMARI Date: 2026.07.02 19:04:48 +0530 2 punishable under Section 20(b)(ii)(B) of the NDPS Act, and was remanded to judicial custody. According to the charge sheet, 16 kg and 680 grams of ganja, which is more than a small quantity but less than a commercial quantity, was seized from the bags and suitcases allegedly found in the joint possession of the accused/applicant and the co-accused. Consequently, the aforesaid crime was registered and the present applicant was arrested. 3. It has been argued by the learned counsel for the applicant that the applicant is innocent and has been falsely implicated in the present case. He further submits that the applicant has been in judicial custody since 09.11.2024. It is also submitted that the charge-sheet has already been filed and that, so far as the status of the trial is concerned, the case is presently fixed for recording the statement of the Investigating Officer. The conclusion of the trial is likely to take some time. He also submits that the applicant has no previous criminal antecedents. Therefore, he prays that the applicant be enlarged on bail. 4. On the other hand, learned counsel for the State opposes the bail application and submits that the applicant belongs to the State of Andhra Pradesh and that 16 kgs and 680 grams of Ganja has been seized from his possession, for which he has failed to furnish any explanation. She further submits that the charge-sheet has already been filed and that the case is presently fixed for recording the statement of the Investigating Officer. Hence, she prays that the bail application be dismissed. 5. I have heard learned counsel for the parties and perused the material available on record. 6. Taking into consideration the fact that the applicant belongs to the State of Andhra Pradesh and that 16 kgs and 680 grams of Ganja has been 3 seized from his possession, for which he has failed to furnish any explanation, it cannot be said that this is a case of false implication. Further, the case is presently fixed for recording the statement of the Investigating Officer. As the trial is on the verge of completion, this Court is of the opinion that it is not a fit case to enlarge the applicant on regular bail. 7. Accordingly, the bail application of applicant – Chutturi Ashok involved in Crime No.34/2024, registered at Police Station: Konta, District- Sukma, Chhattisgarh for the offences punishable under Section 20(B)(ii)(B) of the Narcotic Drugs and Psychotropic Substances Act, 1985, for short, the NDPS Act, is rejected at this stage. 8. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 9.
