JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioner is before this Court calling in question the proceedings in C.C.No.12468/2024 registered for an offence punishable under Sections 420, 504 and 506 of the Indian Penal Code, 1860 ('the IPC' for short). - 3 - HC-KAR NC: 2026:KHC:31886 CRL.P No. 8062 of 2024 2. Heard Sri. S.G. Nandoor, learned counsel appearing for the petitioner, Smt. Rashmi Patel, learned High Court Government Pleader appearing for respondent No.1, Sri. Chethan G.J., learned counsel appearing for respondent No.2 and have perused the material on record. 3. During the pendency of these proceedings, it transpires that the parties to the lis have entered into a settlement and the compromise petition reads as follows: “APPLICATION UNDER SECTION 320 & R/W SEC 482 OF THE CODE OF CRIMINAL PROCEDURE. The above named Petitioner and Respondent No-2 submits as follows; I) That at the intervention of the elders and well- wishers and friends the Petitioner and Respondent No-2 have agreed to compound the offence punishable under section 420, 504 and 506 of the I.P.C., which are compoundable in nature with leave of this Hon'ble court. The Petitioner/accused is agreed/undertake to pay the agreed amount of Rs.35,00,000/- (Thirty Five Lakhs Only) to the Respondent No-2/complainant in the following manner. 1) On 19.06.2026 the accused has agreed to pay a sum of Rs.5,00,000/- to the complainant. And the same has been transferred today. 2) On 18.07.2026 the accused has agreed to pay a sum of Rs.5,00,000/- to the complainant. - 4 - HC-KAR NC: 2026:KHC:31886 CRL.P No. 8062 of 2024 3) On 18.08.2026 the accused has agreed to pay a sum of Rs.5,00,000/- to the complainant. 4) On 18.09.2026 the accused has agreed to pay a sum of Rs.5,00,000/- to the complainant. 5) On 18.10.2026 the accused has agreed to pay a sum of Rs.5,00,000/- to the complainant. 6) On 18.11.2026 the accused has agreed to pay a sum of Rs.5,00,000/- to the complainant. 7) On 18.12.2026 the accused has agreed to pay a sum of Rs.5,00,000/- to the complainant. II) That if petitioner failed to make payment to the respondent No-2 as mentioned the respondent No- 2 is at liberty to file necessary application in the said CC No-12468/2024 case for issuance of warrant by virtue of this compromise petition. WHEREFORE, it is prayed that this Hon'ble court be pleased to accord permission to compound the said offence on the above said terms and quashed the proceedings pending on the file of 46th Additional CMM Court Bengaluru under CC No-12468/2024 which is arising from Rajarajeswari PS Crime No-319/2022 for the offence of Sec 420, 504 & 506 of IPC, in the interest of justice. And further the Respondent No-2 undertakes that apart from this he is not having any claim on the petition in any manner." 4. In light of the settlement arrived at between the parties as afore-quoted, I pass the following: - 5 - HC-KAR NC: 2026:KHC:31886 CRL.P No. 8062 of 2024 ORDER (i) Criminal Petition is disposed. (ii) The proceedings in C.C.No.12468/2024 pending before 46th Additional CMM Court, Nrupatunga Road, Bangalore stands quashed. Sd/- (M.NAGAPRASANNA) JUDGE JY List No.: 2 Sl No.: 1
