In terms of order dated 27.12.2025 passed by the court of learned Sub Judge, Reasi (For short ‘the trial court’), right of the petitioner to cross-examine the plaintiff was closed. Even after imposing cost, the plaintiff was not cross-examined and the cost was also not deposited. 2. Learned Senior counsel for the respondents has very fairly conceded to the submissions made by the learned Senior counsel for the petitioner that one opportunity be granted to the petitioner to cross examine the plaintiff. 3. In view of the above, the order impugned dated 27.12.2025 is set aside and one more opportunity is granted to the petitioner to cross examine the respondent/plaintiff therein on the date, to be fixed by the learned trial court, subject to additional cost of Rs. 2000/-. This order shall however remain subject to outcome of the issue qua maintainability of the suit. 4. Disposed of.
