JUSTICE ASHOK S.KINAGI ORAL ORDER The petitioner filed this writ petition seeking the following reliefs: “a) Issue Writ in the nature of Certiorari to quash the Official Memorandum dated:-25-09-2025 being issued by respondent No:2 vide order No:- ಕಪ/ 100/61845/2025-26/A vide Annexure-C in the interest of justice and equity; - 3 - HC-KAR NC: 2026:KHC:30079 WP No. 14364 of 2026 b) Issue Writ in the nature of mandamus by directing the respondent No:1 and 2 to include the name of the petitioner in Official Memorandum dated:-25- 09-2025 being issued by respondent No:2 vide order No:-ಕಪ/ 100/61845/2025-26/A vide Annexure-C by regularising promotion to the post of Executive Engineer with all consequential benefits since from 10-10-2024, in the interest of justice and equity; c) OR ALTERNATIVELY, Issue Writ in the nature of Mandamus by directing the respondent No:1 and 2 to consider the case of the petitioner to the regular post of Executive Engineer along with all consequential benefits since from 10-10-2024 by considering the representation dated:-17-01-2026 vide Annexure-E in the interest of justice and equity; d) And to pass such other orders or directions as deem fit under the facts and circumstances of the case to meet the ends of justice.” 2. Learned counsel for the respondents has produced a copy of the order dated 21.10.2024 passed by the respondents, wherein the respondents have withdrawn the order dated 10.10.2024. He submits that, the petitioner has not challenged the order dated 21.10.2024 - 4 - HC-KAR NC: 2026:KHC:30079 WP No. 14364 of 2026 despite having knowledge of the same. The petitioner is guilty of suppression of material fact and misrepresentation of fact. Hence, prays to dismiss the writ petition. 3. Learned counsel for the petitioner, after arguing the matter for some time, seeks leave of the Court orally to withdraw the writ petition with a liberty to challenge the order dated 21.10.2024 passed by the respondents. 4. Accordingly, the writ petition is dismissed as withdrawn with the aforesaid liberty. 5. In view of dismissal of the petition, pending IA(s), if any, shall stand disposed of.
