The present writ petition has been filed for following reliefs:- “a. For issuance of an appropriate writ, order, or direction, including a writ of Mandamus, directing the respondents to forthwith conduct an enquiry into the documents on the basis of which the Scheduled Caste Certificate was issued to Respondent No. 8 by the Circle Officer, Baghmara, and thereafter hold and declare that the said certificate is not genuine, as Respondent No. 8 is a permanent resident of the State of Uttar Pradesh and is not entitled to obtain a Scheduled Caste Certificate or claim the benefit of reservation in the State of Jharkhand. 2026:JHHC:6417 Page | 2 W.P. (C) No.1284 of 2026 b. for cancellation of the election of Respondent No. 8 as Mukhiya of Tetuliya Gram Panchayat, Baghmara Block, District Dhanbad, on the following grounds: i. That she contested and was elected from a constituency reserved for Scheduled Caste candidates on the basis of a caste certificate for which she is not legally entitled, being a permanent resident of the State of Uttar Pradesh and, therefore, ineligible for reservation benefits in the State of Jharkhand; ii. That the caste certificate used by her for contesting the election, bearing issuance date 01.11.2015, was no longer valid at the time of election, as it clearly mentions its validity only up to 01.11.2016;” 2. After some arguments, learned counsel for the petitioner seeks permission to withdraw the present writ petition with a liberty to work out his remedy in accordance with law. 3.
