Ajay Mohan Goel, Judge (Oral) By way of this writ petition, the petitioner has inter alia prayed for the following relief:- “i) That the Memo. dated 5.3.2022 at Annexure P-4 to the extent instead of converting the Petitioner from Piece Meal Worker to the post of Junior Technician, on contract basis, in the pay band of Rs.5,910 - 20,200 + Rs.1,900 Grade Pay, he has been converted to the post of Workshop Helper in the pay band of Rs.4,900 10,680 +Rs.1,300 Grade Pay, much lower post, may kindly be quashed and set aside and he may kindly be held entitled for his conversion to the post of Junior Technician w.e.f. due date, with all consequential benefits, in 1 Whether reporters of the local papers may be allowed to see the judgment? 2 2026:HHC:6535- the interest of justice.” 2. The grievance of the petitioner is that he has not been considered for appointment against the post of Junior Technician on contract basis in the respondent-Department upon completion of 5 years of service as a Piece Meal Worker. 3. The stand of the respondents is that as the petitioner was not possessing the requisite qualification, i.e. certificate from the ITI in the concerned Trade, therefore, he was not considered. 4. It is not in dispute that the name of the petitioner, in terms of Annexure PR-4, dated 05.03.2022, was recommended for conversion against the post of Junior Technician on contract basis, but as the petitioner was not possessing the requisite certificate, in the trade of Motor Mechanic, he stands ignored. 5. As indeed the petitioner is not possessing the certificate in the trade of Motor Mechanics, though no relief, as prayed for, can be granted by the Court by issuing a mandamus, however, as prayed for, this writ petition is disposed of with the direction that in case the petitioner is so advised, he may approach the Authority by way of an appropriate representation and the Authority may consider the case of the petitioner by relaxing the condition in light of the service rendered by the petitioner with the Department as a Piece Meal 3 2026:HHC:6535- Worker, if permissible in law.
