Borthakur, learned Additional Public Prosecutor appearing for State respondent. 2. This is an appeal filed under Section 430 of the BNSS, 2023 for suspension of sentence and to allow the petitioners to remain on previous bail during the pendency of the appeal. 3. It is submitted by Mr. Poddar, learned counsel for the appellant that by the Judgment and Order dated 20.01.2026 the learned Sessions Judge, Chirang in Sessions Case No. 20/2025 had convicted the accused/appellant under Section 61/115/140(3) of BNS and sentenced them to pay a fine of Rs.10,000/- each for the offence under Section 115 BNS in default to suffer simple imprisonment for 1 month and undergo simple imprisonment of 2 years for the offence under Section 140 (3) BNS with fine of Rs.5,000/- each in default to suffer imprisonment for 1 month and undergo simple imprisonment of 2 years for the offence under Section 61 BNS with fine of Rs.5,000/- each in default to suffer further imprisonment for 1 month. 4. The learned counsel for the appellant has submitted that the petitioner is still in previous bail and accordingly he is praying for allowing him to remain on previous bail till disposal of the connected appeal and suspending the sentence imposed upon him vide the said Judgment and order. 5. Mr. P. Borthakur, learned Additional Public Prosecutor appearing for State respondent raised no objection in that regard. Page No.# 5/5 6. In view of this, the present interlocutory application is hereby allowed and the applicant/appellant is hereby allowed to remain on previous bail till the disposal of the connected appeal and the order and sentence passed in the Judgment is suspended till the disposal of the connected appeal. 7.
